Just looking to see (outside of your state / local laws) how long do you let tenants get behind in rent before you "act" (whether it's a notice, phone call, formal notice, etc)?

This came to mind because I was in court a few months ago and landlords/tenants were there with 3+ months behind and now I saw that someone posted where tenants were 6months behind "but always paid up".

I'll go "first" (haha) and say that I typically don't allow the tenant to get past the first week (late on the 4th) but it DOES (sometimes) depends on how "new" they are, if we've "been here before" or what's going on (they are talking to me vs me making all of the effort, etc). I've never let anyone get more than one month though. That I recall LOL.

Rent is due on the first late by 5pm on the second. I have a few that are on pay day payments (thanks y'all). I wouldn't let anyone go past 3 or 4 days and of course they'll be paying late fees. --47.188.xx.xx

Rent is due on the day it is due and late on the day after it is due. If not paid or not paid in full, I send a brief text saying how much is due today (late fees includes) and to pay asap to avoid further late charges. If not paid by day 7, I file on the 8th day. --173.20.xxx.xxx

Eviction is expensive and time-consuming. I always get the state legal maximum deposit of 1.5 months as a backstop to uncollected rent. I don't see the point to filing eviction if the tenant pays a week or two late. The main problem is that the eviction process takes so long that you have to initiate the process early even if the tenant pays and you don't need to follow through.

That said, if a tenant has been very unreliable in paying and indications that they are stretched financially, I will send pay or quit letter on the 2nd, but not file until after the 11th when my $100 late fees accumulate. I have yet to need to evict anyone, and the two instances when tenants move out on their own, the deposit was enough to cover the lost rent and damages. --50.4.xxx.x

While wanting to avoid a eviction what happens with one month of arrears it becomes two months then three months where soon it is six months. So better to start the eviction right away then wait for more arrears. If the tenants pays off the arrears then the tenant stays if not mitigating losses. More often then not they pay off arrears where things only get nasty then they are calling the building inspector. For some tenants living rent free for a year is possible by two evictions. In future it is better to run thorough credit checks on all adult applicants where avoid problem tenants altogether. --147.194.xxx.xx

To me, it’s not a big deal to wait. I have a couple renters that wait until the last possible day to pay before late fees kick in. And one of these sometimes pays past that date with the late fees. If I don’t get rent by the cutoff date (5th) I text and ask when they are paying. If they say next Friday when I get paid I say ok. Have not had them not follow through with what they say yet. But if I didn’t get it then, I’d ask when they are paying then file if it was yet another week. --173.26.xx.xxx

Notice goes out on day 5.

So far, that's always been enough.

My tenants who mail checks get a phone call on day four, just in case the post office messed up, they have time to drive me a check before they owe a late fee. --174.216.x.xx

In most cases when the rent is late I give the tenant a call, texted message or email. If we can't come to terms, then after 10 days they get a 3 day notice. After two weeks to a month they will be served with the eviction papers.

I have a "Notice of non-payment" form with blanks to fill in tenant's name, address, rent owed, date due, and total including late fee due by 6PM in 5 days. VA requires me to give them 5 days to pay. They get this notice the very next day after rent is due.

I have one roomer now who gets one every Saturday for rent that was due Friday, and he pays with the late fee every Wednesday - day 5.

cjl,

If you go back a few years in the archive you'll see me bragging how I put 3 kids thru Purdue University on late fees. True.

BUT...

when I added it up I lost $50,000 per year in unpaid rent and damages during those years because residents who are late eventually cannot catch up. Wifey was on the phone all day every day chasing people and hearing lies. Late fee income? Big whoop. Better to have the rent now that a few bucks in late fees IF they pay.

For the last few years we have been ZT ZERO TOLERANCE on lates and believe me, they pay. No more chasing and phone calls. It's the LLs who ALLOW or even TEACH it's OK to be late.

Weekly rents and autodraft help a LOT!

If someone does not pay on Friday we send a 3 day text and most pay. The very few who do not are filed Monday afternoon because some can't get the money until Monday.

A few banks are now 7 days a week so Sunday works for payment.

CAUTION: in this economy people do not have money or savings. ANY delay is a huge risk by the LL.
