Usually, these sorts of ordinances are from people who live in neighborhoods close to a University, and they want to cut down on the number of students who are "invading" their neighborhoods.

yes I have some students and professional tenants , but they never have problems

when I sign lease I ask them no party.

and they are busy with their study and work, during the weekend, they work or drive to home. no body there.

this is not good town. except students and other professional, many applicants have eviction history, hard to find tenants without eviction history.

students and single professional groups are rent guaranteed group

I am sick and pain to go to court to evict people .

Our town several years ago started implementing some of those same ridiculous rules. We formed a landlord association, went to Town Council meetings and then hired an attorney to come to one of the council meetings to dispute some of the rules.

The members don't pay the yearly fees nor do they allow the towns mandatory biyearly inspection of their apartments for $50 per unit.

Our tenants have the option to sign a Right of Entry Form, essentially stating that it's their 4th amendment right to not have unlawful searches and seizures in their apartments.

I bring those forms to the code enforcement and there isn't anything they can do except go to court and get a search warrant (need to find probable cause) and force their way in. That would not make good news for the town if it went to the TV stations. It's a way for them to extract more money out of us LL.

They know who they can bully and who they can't. Try to get more landlords together and fight this. Look up how unconstitutional some of these "laws" are.

personal ,I would like to rent families, since they are stable. But too many eviction applicants , and also I experience a couple of eviction , it cost too much money , time. I am scared of bad tenants.

Depending on the situation I don't blame the residents. But the rules should apply to all homes in the neighborhood.

Bad landlords with bad tenants cause these issues and concerns. As well as some bad owner occupiers.

Is this for the entire town? In a nearby university town they did this, but I can’t remember if it was only for single family homes or if they zoned residential neighborhoods this way. It was to keep animal house type parties from happening where families lived. Landlords that owned houses in residential neighborhoods and rented to large groups of students were forced to sell. --24.61.xxx.xx

What Lisa says is correct about not blaming the residence. I live next door to a 3 family house and since it was sold a few years ago and students moved in there have been several incidences. I call police, call the college, make a housing complaint to the town. The police are very good about not tolerating the parties. It calms down though after threats of disciplinary action from the college.

Also about the rules applying to ALL rental homes. Our town was only targeting 2 families and up, NOT the single family homes! This is discrimination!

Many cities look at rental housing providers as a cash cow they can keep milking forever. In reality those costs are passed directly on to tenants in higher rents which in turn discriminates on those with less incomes. Write editorials in newspaper then with landlords association have a meeting at city hall with council members. Keep the pressure on city by writing in newspapers along there absolutely no justification for that kind action. Here some landlords association have fought off licensing as this is only cash grab forcing out any of the smaller rental housing providers which causes the price of rent to rise where it becomes impossible for people to live. --147.194.xxx.xx

Yes in our city , if Tenant’s park in the driveway passing a little line to grass also belonging to the property , city fine 300 dollars per day

If tenants put any kind of trash infront the house even in the house property , city fine 300 per day

It is really bad .

I keep to tell tenants not to do that , but not match use since tenants do not pay fine

Others on here have given some ideas. Good or bad, useful or worthless? You have to decide.

Following are some of my ideas. Good or bad, useful or worthless? You have to decide.

I have only been fighting city hall for about 2.5 years now. Hoping it will end soon.

1. Does your town leaders believe in the Bible? If everyone came from Adam and Eve then we are all related.(grin) City would have to say to what degree of relationship – I would think.

2. If ALL tenants in all properties are not effected I would think there would be a problem for the city.

3. Will they require just the landlords to register what they own or ALL property owners to register. Register how many live there today, last week, next week? This could work to your benefit in that tenants can’t move extra people in without letting you know or else they have a fine twice the amount of the city fine.

4. Most affidavits that I know of here in Missouri say, “To the best of my knowledge.” Remember the military “don’t ask, don’t tell” policy. Well “don’t ask, don’t tell” for your tenants. Just say “To the best of my knowledge”.

5. Just because you are not allowed to ask those questions does not mean the city (gubment) can’t ask. Look into it and find out. Also how you ask can make a difference. I did some work for the public health Dept. We could not ask someone how old they were but we could ask how old they were on their last birthday. Go figure

6. Don’t refuse. Just give them a vague answer and don’t lie. Answer “To the best of your knowledge”. Did they say in what language you had to answer? Learn how to write and answer in “ yapines” and “pickkastan”

7. Here is your ticket. You can complain about ANY PROBLEM. What my lawyer had me do. Get a yard stick, paint it blue up to 7 inches (allowable height of grass – weeds) in our hamlet. Go to ALL property in town and take pictures (more than one) of any grass that is over 7 inches high. Take pictures every two weeks. Hard to do in the winter time. Place the yard stick among the grass when taking the picture. Even the grass on city owned property. I hope you are getting the drift here. Drive the town and take pictures of vehicles that do not have current license plates. Those that do not run and are on blocks. Any buildings that do not fit code. Leaning, missing shingles, damaged siding, broken or plastic on windows. Land that has brush piles, trash piles, dirt piles. Parking lots that are not paved (creates dust hazard). I don‘t know the size of your town but if anyone has animals(chickens, cows, horses) and so on make sure they are in the correct zoned area. I hope you are getting the idea. Your ordinance book can give you tons of ideas. Everything it says is a violation go and look for it in your town. Take a picture and don’t ask city about it but write them a letter asking about it. In Missouri we have what is called a sunshine law. Google it. This says the city must answer to the citizens within 3 business days. If 20 citizens write in and ask about 20 different complaints (each day) your city clerk could be busy for a day or two.

8. What happens if the tenant gives you rent anyway?

Get copies of your city ordinances and LEARN them. No one will fight for your rights like you will (I hope). Usually there will be a section on public nuisance. Study that section. Now it is time to negotiate with your city.

Funny thing. When reading our city ordinances I learned we are not allowed to have wharfs in town. What kind of wharf would you find in the mountains.

DISCLAIMER. ABOVE MAY LAND YOU IN JAIL. JK. For me the city dropped all charges they had against me. Now they won’t even write me a ticket (citation) when I ask them to.

Forgot to mention that you do not want to tell the city who had or address of where you find violations. Make a map of your city and just put brightly colored stickers on the map where you find problems. Be somewhat close but maybe a street of two off. If the city wants to know tell them to go look for themselves. You do not want to be the stoolie, the snitch, the informer, the yada yada yada.

Let the city know that this ordnance is from mostly owner occupied units. As a LL in an upward market place, you will be under appreciated. In my small town 100% of the foreclosures were owner occupied dwellings. Many of the blight issues come from foreclosed properties and not rentals ran properly.

With where the market place is, such an ordnance is a bet the city is making that values will not be dropping where investors will go in and clean up places. Rather the bet is owner occupants will be able to police themselves to clean up places when coupled with city regulation. This proposed regulation only pushes away the real estate safety net that investors provide by bringing in capital when the community needs it the most.
