A few years ago, when my sister and I inherited 7 duplex homes throughout Western Massachusetts, we thought we would soon be set to take early retirements. However, after looking closely at the rising cost of several maintenance issues - mostly Snow. Ice & slush removal - and asking two lawyers for help us in drafting new terms requiring that the tenants handle these concerns (The same way our late father did for decades}

First, Apparently your last sentence was slightly truncated.
In any case,it looks like you were getting 2 different answers frpm your 2 lawyers on whether or not you can legally write your leases so that that tenants would be fully responsible for handling all snow, ice,and slush issues on their own.
My property management attorney did this for me ALONG WITH having each tenant sign a separate form that essentially "releases" me from any all related liability.
Finally, where Massachusetts is such a treacherous State to conduct business in, I hope my lawyer got it right and I did the right thing!

In mass the landlord is responsible for clearing snow from common driveways and entryways in a multiple occupancy home. Not sure there is a way around this. --24.147.xx.xxx |

Asking them to shovel other than just getting the car out makes you their employer in case of accident. Hire someone to shovel main walks and clear drives. I did it myself here in NJ by putting mechanical equipment at each building or group of buildings. It is solar minimum for five years until 2021 so don't expect any warm winters but colder may prove to be drier that it has been. . --173.61.xxx.xx |
