Last month I took my ex T's to court, Order to Show Cause, re: non filing of Interrogatories. One of them showed up in court, with partially filled out paperwork, the other, a letter was faxed the day before court with excuses as to why he wasn't able to file (this is a married couple)

Judge decided to give them even more time (grrr) and asked met to write a letter as to the items I would like to be produced.

My question is, In my letter I would like some advice as to asking for supporting documents to prove his allegations? His faxed letter states he's been working out of town as a truck driver and also had to assist in taking care of his parents.

I know for a fact he has been in town as I've seen him, so I know he's lying.

She also left her job to avoid the garnishment I had served.

C&J,

I don't believe people leave jobs to avoid garnishments as much LLs think. start here: they were flaky and irresponsible so you had to evict them. They are STILL flaky and irresponsible!

My judge will go as low as $5 per month if the person asks.

Sounds like the judge is giving you a marvelous opportunity! To require the defendant to give you everything you want!

copy of lease

current employment

paystubs

additional sources of income

I don't want to see all their util bills etc because iit proves THEIR case to reduce the garnished amount. I want to see INCOME.

Thanks for the words of encouragement!

I did get a lot of information from her incomplete Interrogatory. Lots of inconsistencies, (lies) too.

The best was in court when I requested a damage hearing, I knew the judge would ask for their new address to mail summons, and sure enough, she did and I was ready with pen in hand, they were not happy, HA

In this case, I do believe she took a leave of absence to avoid garnishment. She is technically still an employee, per the payroll lady at her job.

He, inadvertently (I'm sure) gave the name of his employer in his letter to the court.

The problem is they are liars, and I'm hoping the judge sees through the lies.

I have requested both interrogatories be filled out completely and truthfully, and ALL supporting documents required be attached. As well as documentation to support the claim he has been unavailable since Sept 5 to file interrogatories. I have more information on them than they realize, its just the chase I'm getting tired of. GRRR

Honestly, I am considering turning them over to the local collection agency. --67.143.xxx.xxx

Two things:

- Judges are not stupid. I suspect the judge is giving your ex tenants the rope to hang themselves, play along.

- I view tenants who fight me on the process an teachers. They teach me how the systems works and what I need to do to OVERCOME. Work through the process with them and be grateful for the education. --108.51.xxx.xxx

Brad, I had an applicant making $115,000 a year who was able to BK for a $15,000 debt because he didn't want to pay the debt. People do stupid things without looking at the long term consequences. Income over 3X times rent but the BK disqualified the jerk. --99.23.xxx.x

Make it an order of the court that if they change their residence or they change their job thEy must notify the court .......so it is in THEIR file.

Once it is an order of the court if they don't......CONTEMPT OF COURT AND A WARRANT IS ISSUED. !!!!!!!!!!

As much as I have words of encouragement-- I can't. When going before the man our policy is get a mouth piece. Fact is these judges and atty's all belong to the same club. You will find judges don't pull this B S with atty's and it's more cost effective to get a good atty. (Same as you have good plumber/ac man/ elect. Etc.Etc.. --99.103.xxx.xxx
