In my state yes. I would think... yes in all states. But someonefrom NJ will come along with some helpful information. I usually find out that they own more money than the deposit so just go thru the accounting. --99.203.xx.xxx

The SD is considered to belong to the T and you are just holding on to it as the custodian.

You are allowed to deduct money from the SD to cover for certain losses caused by the T. You have to provide an accounting within a specific timeframe (most likely 30 days from the end of the tenancy) and incluse with the accounting thr amount remaining after deductions (if any).

The items you can deduct and the amount of time permitted vary by state. But NJ's LL/T laws are pretty T friendly so I'm certain you have to provide it within 30 days. --174.234.xxx.xxx

You can be a bit generic though...

"Electrical - $125" rather than "You broke the light fixture so I charged $35 for a new fixture and $65 for the electrician"

If the tenant wants more detail, they can go to court to find out...so as long as you're willing to go to court...be as generic as is reasonable. Photos help a lot too, I tend to be a bit specific and show photos where possible...although some things don't show up well in photos.

Yes, and you must have receipts to show the tenant where the money went. If you did cleanup yourself you can't deduct the work only the cleaning products etc. You do this within thirty days and send the balance certified mail RETURN RECEIPT REQUESTED so they have to sign for the envelope. Don't skip any of this because the penalty is sending them double the deposit you withheld. See the booklet online Truth in Renting. It's published by the Department of Community Affairs in Trenton. In CA, a landlord who fails to follow the law, is punished irrationally. I think that NJ is following CA laws.

Don't open the door for more trouble, prepare a closing statement, send it to last known address and be done with it.

If the T owes you money, try small claim court. In most cases, Ts escape the law like rats. --99.59.x.xxx

Thank you all for your advice. I will make up a letter and send it out tomorrow. I'm not going to bother putting in it the damages as the rent owed is higher than the security deposit.

Christian, you definitely should include damages. Include anything that is covered by the deposit. If the total amount of deductions is more than the security deposit, show a negative amount and demand payment for the amount owed. If they don't pay, you have the option of filing suit in small claims court. Keep your options open by including all amounts owed. --71.233.xxx.xx

I agree, put everything down. If somehow they ever went to fight you on something you would regret not including everything. If you haven’t repaired something yet or you renovated something vs repaired so don’t have a bill, use an asteroid saying, not completed yet or not charged. The more ammunition the better, whether you follow up and chase them in small claims court or not, you want it all documented. --24.61.xxx.xx
