Have a set out the 6th of Dec. Guy packed up yesterday into u-haul. Today he texts-- all nasty-- how he had the money we wouldn't take it (he had 1K and owed for 2 months and court 2250.00). So he beats around the bush about us taking house back.
I just got back and we're going to let the sheriff do it. Yea it was kind of empty inside but there were 2 big screens and 5 mattresses and 2 bed frames-- refrig and food in cabinets. Normally we'd take it back and if in halfway decent condition cancel sheriff. So we'll let the sheriff be the documentor of condition. Set out should take about 10 minutes.

I've had a fair number of times where the marshal has walked through an empty rental house.
I know the tenants have left but I've paid my money to go through the eviction and I still want this on the tenants credit history. And, as previously mentioned, there will be paperwork signed legally giving me back my rental property.

6X6: It depends on your laws in TN. (if you haven't yet, follow the link above or use google to find them. Print, study, and learn what they are!)
Generally, though(here) - you hire a couple strong people to move stuff to the curb quickly while the sheriff watches, then you change the lock.

I'm continually amazed at the # of big screens (i.e. large, monstrously heavy rear projection type) from the 1990's are still working well. We just bought a new personal residence recently, and the former owner left his big screen. Back then, I recall those things were great; now they hurt my eyes to look at since I'm used to seeing HD resolution.
We offered it for free if someone would haul it away. Yep, had a taker the same day. Hauling it up the side of the yard (walkout basement) was a chore....but it's GONE!

6x6 how it works. A writ of possession is applied for after court. Judge signs papers and sends it to sheriff civil division. Although the offices are about 100 ft apart it takes 3 or 4 days for the sheriff to acknowledge receipt. Once the civil division has it in their computer -- the sheriff clerk looks at the computer for a time that's open for the sheriff to supervise the set out. We supply the man power. YOU must have 4 adults there when sheriff shows up.
He verifies with his office that no STAY has been issued and knocks-- hand on gun in holster. When no one answers we give him key and he enters. Walks around looking for anything illegal then gives us the thumbs up to come in and bag the stuff. Crew Carry's it to curb. Once he found child porn and when he found out where the guy worked from us-- he had his fellow sheriff's go to the place of employment and arrest the guy. We also check the criminal calendar prior to sheriff coming-- if there's a warrant we advise the sheriff and he brings "extra" help. --99.103.xxx.xxx |
