After the tenants are evicted in Michigan. What do you do with their belongings. Things that are worth money? Throw away? Keep or sale for lost rent or damages? This is my first eviction. Please help. Should I take inventory and store away? --99.203.x.xxx

There is no law in Michigan regarding abandoned property and thus I address the issue in my lease. If you are evicting a tenant, the sheriff will remove the tenant and depending on your local laws a crew will place the belongings at the curb. --67.149.xxx.xx

Hank,

I WANT them to come back and get their stuff but they don't.

In real life they SELDOM leave ANYTHING of value. In our 300+ evictions over 41 years I can only remember 2 people who left anything of value.

(a new video camera with tapes marked "Mary's first dance recital" and another person left some old military medals when he was taken off to prison for murdering his wife in my rental)

I put these things in a box with their name on it and set it in my storage garage. I told the video camera person I saved it for her and was happy to return it but she never asked.

The murderer is in for 80 years.

The rest was junk.

Take tons of photos to prove it was junk you threw away.

Stay strong. Follow the eviction system. Get the place cleaned and re-rented quickly.

After a period of time the abandoned property can be donated to charities as someone is going to need furniture, clothing. That way the landfill will not be filled up. So google to find local charities. Some Habitat for Humanity restores take furniture. --147.194.xxx.xx

Michigan law is poorly defined on lots of things -- and, as CGB said, this is one of them.

If there is anything of actual value -- and you haven't clearly defined what happens in your lease beforehand, then I would store it for a while -- probably 3-6 months actually -- along with sending a notice to them on how to contact you to get it and how much the storage will cost them. Include in that an exact date that the items will be considered abandoned and that they give up all claims to it after that date.
