Hi,

Need your expert advise.

We have a rental property. Our next door neighbor's tree branches fall on our property.

I know I have the right to cut the branches that on our property. My question is do I have the right to put the branches back on his property, as he refused to share the labor and dump fees for his share.

Well I wouldn't like that, but I suppose if it's now in your yard, it's your's so no I wouldn't put it back over the fence in their yard. Just get it cut up and put in bags for yard waste. --173.108.xxx.xx

My neighbor's tree is like that. He had all the heavier branches cut back and it produced weaker outgrowths which are now quite large and fall in my yard. I moved all my bird feeders out of that area. Too dangerous.

So falling branches are an Act of God. However I believe if a tree is dying and is a hazard, the owner is responsible for fixing the problem or they may get sued later.

No I would not throw them back in his yard as an Act of God is not his fault and you could hurt someone who fell over them later and you might be on a video camera. That doesn't mean I haven't done it.

Look at the good part of the tree, the oxygen it produces, the pollution it filters and the shade and privacy it gives.
