State Specific Question About: FLORIDA (FL)

Hi everyone,

We live in CA, but my daughter owns a rental condo in FL. Tenant hasn't paid October rent. I am going to be in FL and planned to go to the unit and hand the tenant a 3 day notice.

A Realtor told me it must be an 8 day notice to allow for mailing because I don't live in the same county -- even though I will be handing her the notice.

I wouldn't take advice from a realtor. Can you accept electronic payments? Are you in town 3 days? If you are, have them pay you before you leave. If not, then file.

If it's left posted on their door or handed to them in person it's a three day requiremet. The realtor is correct only if it's sent via mail.

If this is your first 3 day notice and/or eviction, do you really think it's a good time to learn how to do it?

One wrong word and the judge will throw the case out, you will have to start all over again.

Thanks to everyone for their suggestions. In trying to be brief, I guess I left out some important details.

Tenant has been in the property many years, and we've had a good relationship. She gave notice (less than 30 days) that she would be moving for a job transfer. She still hasn't paid October rent and has been uncommunicative.

Since her new job begins on Monday, we really don't expect to have to evict the tenant (and we would hire someone if an eviction was necessary).

We thought she might pay rent when handed a 3 day notice. We also thought the 3 day notice was required to collect unpaid rent once she moves. Maybe we're wrong about that too??? I've meaning to try the collection service on this website.

to NE: We belonged to an investment club in 2003 and bought a few properties in FL when homes were appreciating around 30% (and you only had to breathe to get a loan). Florida homes were much cheaper than homes in our area, so it required less money to purchase.
