On an eviction, once I receive the writ of possession from the courthouse, am I doing myself a favor or disservice by not spending the money on the sheriff to "clear" the premises-- if I actually know the folks have vacated? Or do I follow it through to its final completion by paying the extra 100.00 or so for the sheriff to come out. What are your thoughts? Once I have the writ, it doesn't matter what they might have left behind, right? -- they can't say later that they left a diamond ring there, etc...because I have legal possession via the courts. Big question is did they leave the keys for you? If yes I'd take it back and document keys and utilities. Take pics of the place.

If none of the above I'd wait on sheriff. You went this far soooooooo. Here in GA if the sheriff knows we've been inside-- "and know the tenants gone" he won't do the possession. He says-- well you've already taken possession you don't need me. So be very careful of what you say. Yes to pay the 100.00 and complete service. --192.168.xxx.xxx

I usually want to have the Sheriff finish off the eviction, just so that all the strings are tied. My "better half" does not see the need if the property is in fact vacant.

My cost for the Sheriff to do it is under $100, and they will usually do it in three days.

For me, the Sheriff's clearing the property and turning possession over to me does NOT have anything to do with storing the now-ex-T's personal property. I have to maintain it for 30 days after I recover possession. You need to know YOUR state's laws.

One time my evicted tenants left an hour before the Sheriff showed up. They entered the apartment, checked for signs of life/people and then issued me signed documents saying I now have possession. I then re-keyed the locks. I left the property to show a vacant house a few miles away. Upon returned my evicted tenants had broken back in and took up residency again.

I called the police. The police showed up within an hour, the police station is only a mile away.

Once there the tenants told the police I pointed a loaded gun at them and made threats. They police then handcuffed me and placed me under arrest. I had to remind the police that when I called 911, I reported my evicted locked out tenants had broken back in after the Sheriff's lock out. So the police asked for my paperwork. I told them on the passengers seat of my car is the folder containing the court eviction, lock-out appointment with the sheriff's department and the final documents giving me possession by the Sheriff's. The police called the Sheriff's to confirm they had done a lock-out. The Sheriff's, working close by on other lock-outs came back to the building and were amazed I was still in hand cuff's and that they believed the evicted tenants over an owner.

HAD I NOT HAD THE SHERIFF'S LOCK-OUT WITH DOCUMENTS, I WOULD HAVE SPENT A NIGHT IN JAIL, HAD TO HIRE AN ATTORNEY AND PAY A $1,000 BOND. The lock out save me.

The next day I purchased a Taser Dart Stun Gun knowing the next tenant that tries to pull a fast one and break into a property, I will be ready to stun, tie up and then call the police on my terms...not theirs. --47.156.xx.xx
