Tenant didn't pay rent since September. I'm in the process of filling eviction lawsuit. Lawyer said earlier to file is 10/ 16/18 Tuesday.

Tenant had multiple time lie about moving out (10/8, 10/10). I saw moving truck parked in front of the house on 10/11.

Last email from tenant they mentioned they will be out on Monday (10/15). I emailed back and said that come Monday if there is still stuff inside my house,those are considered trash and will be throw away.

I went back to check on the house this morning (10/13) and most of their stuff were gone. Only some small stuff, toy, trash, a TV (not sure if working or not).

Question is come Monday, if the stuff is still in my house, can I trash them? I plan to change lock on Monday as well. --98.194.xxx.xxx

Even after obtaining possession of the house, you can't just throw away whatever they left without following your state/city rules. Ask your lawyer for the specifics.

If you do, they will slap you with a large lawsuit, with fake receipts attached.

Give them until midnight on Monday the 15th. If you walk in on Tuesday and there is still stuff there, toss it. If they come back and complain a valuable is gone say when you showed up Tuesday the front door was left wide open and you walked into...nothing.

Your lawyer should know the timetable you need to follow. Gail k can't really think what she suggests will fly in court. You don't give specifics about what your tenant communicated in writing and if they are breaking the lease or using the deposit as last month rent or what your lease says. Aside from court if you really believe they walked away and the utilities are off take steps to secure the premises and prop the fridge open so it doesn't get skunked. Take pics of the stuff and keep it in a corner til time runs out. Skip the eviction and save a few bucks. --66.87.xxx.xx

Dont know about TX but I would take a few pictures and dispose.

However, in NH our judges still have common sense if it came to that.

Decades ago a Parent came and got his daughters stuff to save her from eviction. She got a lawyer. He called me and after learning the facts - never heard from them again. - Common sense prevailed --24.34.xx.xxx

once you have writ of possession the constable will put all the belongings on the curb. a free for all for the neighborhood and passers by. anything left put out for the trash man. I have garden hoses, tools, work bench picked up at such put outs. --166.137.xxx.xx
