My Notice to Quit is ready go for 15 days notice. Tenant's lease ended a few months ago--does not automatically renew. They said they want to move in less than 2 month and don't want to pay to live there, when already behind on rent. My Notice to Quit is very basic, stating to remove themselves, all other persons, and all personal property from the rental unit occupied. I did not give a reason. Must I give a reason directly on the Notice? The money and the expired lease issues will be addressed on the Landlord/Tenant Complaint. Thank you. --71.112.xxx.xxx

Fifteen days? Shoot, I am half way thru an eviction by day 15.

The original poster is confused between two different things:

1. Notice to quit is used when tenant has violated lease term, even with a month to month lease. You have to inform them what term(s) they have violated.

2. Notice of termination is used to tell the tenant that you do not wish to renew the lease. On a month to month, you have to give 30 days notice before the renewal term. If they do not leave, then you issue a notice to quit.

His tenants were on a month to month lease AND were behind on their rent, so he could and should issue both. i.e., I am not renewing your month to month lease (notice would be effective as of Nov. 1) AND you must get out within 15 days (assuming notice to quit not waived in lease) because you owe xxx dollars in back rent. --73.141.xxx.xxx

I would also file in small claims court for past rent owed

reason: right now you know where to serve them - later on - good luck

When you get to court make sure to ask Judge to make it an order that they inform the court of their future residence --24.34.xx.xxx
