Tenants' lease ended 6/30/18. They had been there over 3 years and I knew they wanted to live in different part of town. In June they told me they wanted to move in a few months so I did not update paperwork and just let it go month-to-month. I suppose this was a mistake, because as of a few days ago, tenants completely changed attitude and said they have squatters rights and will not pay, that will have no responsibility for the unit. I am trying to figure out if I give a 10 day or a 15 day Notice To Quit since the actual lease expired in June. They said they will leave Nov. 1st up to the 12th. My main concern right now is with the time that must pass through the courts and to get possession, what if they are no longer living there during this court process? Can I still get a hearing and a judgement? Thank you for your help! I haven't had an eviction in 10 years. --71.112.xxx.x |

Even though your lease expired in June, the same terms and conditions of the lease are still effect on a month to month term if no notice was provided by either party. If your lease contains language to waive the 10 day notice period you can file immediately. If it doesn't contain this language you need to post the notice and file in 10 days.

Such a crazy world we live in today, they go from being 3 year tenants to verbalize they are squatting. I’m guessing it is beyond discussing it with them, but you could try explaining they are still under a lease, just month to month and not squatters giving them the option of paying today before you post the paperwork. Next time, if you mutually want to choose a shorter timeframe agree to a 3 month or month to month lease and write the lease that way. Then everyone is on the same page. --24.61.xxx.xx |

Yu can do a Notice To Quit, but I find a Notice to Pay or Quit is much easier. Eviction for non-payment is the "norm" -- the judge/magistrate is used to these and doesn't really think about them.
For me, a Notice To Quit has to be followed by another notice, after which I can finally ask for eviction. Takes about 20 days longer.
I'd do a Pay or Quit, and take the risk that they will pay. After all, if they pay, I don't care if they stay.

I called an attorney and he wanted to do the entire process, but I think I can do at least a portion of it myself. He didn't give me much time on the phone, but he did say being that the lease is month-to-month with no written contract, I should really be giving a 30-day notice--to be sure, as a non-renewal. So this confused me. Does anyone have any experience with this? I'm ready to give a 15-day Notice to Pay or Quit, using Mike45's advice here, to state to pay what you owe by dateXXX or move out by that date. 30-days is a long time to wait, as I would like to have this landlord/tenant filing on record while they are there. First, READ your lease. If it is a Pennsylvania based lease (rather than a generic Staples or internet lease) it will have a clause that states after one year it rolls into month to month, with the same terms as the original. It also should contain a waiver of notice clause. If you have both of those clauses, file tomorrow. You will get September and at the hearing update adding October rent. If you file everything timely, they'll be out before November is due. --72.70.xxx.x |
