I'm buying a home thats right next to me next weds.I will be doing a inspection with the owner while tenants are there tomorrow. they dont have a lease,moved in when a relative moved out.This is MO.I want them gone but it will be awkward since they are next door and share a long driveway.any advice guys,gals.? thank you in advance.K --107.77.xx.xxx

Last building I bought nobody had a valid lease. I offered a chance to sign my lease (no pets, no smoking but same rent amt) or an intent to vacate form giving 30 days. They had 90 pound Rottweiler so I worked with them and it took 45-60 days. As long as rent was paid on the first, I agreed to refund prorated rent if they were able to find a place and get out mid month. I tried to make it easy for them and kept it professional. They didn’t like it, but we had no issues. Choose something in your lease that they won’t want to stay (market rent raise, animals, smoking, lawn mowing, etc). Good luck. --24.61.xxx.xx

Then you can do one of two things:

1) Make the sale hinge upon the emptiness of the property. If the tenants are there, no closing for the seller. Let the seller handle the people part of things. "The new owner needs to renovate, and can't do it in an inhabited house..."

2) You can make it their idea to leave. "Hi, I'd love to keep you for [whatever amount makes them worth your while]. Here's an application to fill out." And they can either pay $x/month, and you can delay doing what you really prefer to do with it; or they can say, "That's ridiculous. We're going to find a place elsewhere."

People who just "move in" when a relative moves out are going to be used to upping and leaving. They might leave various amounts of stuff behind... but part of the lifestyle of wandering-in is the getting-kicked-out bit at the end. --96.46.xxx.xx

When I'm going to buy a property and I want it vacant before the close of escrow, I ask the seller to deal with his tenants. If by some change I see that it's not going to happen, I demand an amount help over after escrow to compensate me for:

A) any lost rent

B) damages by the tenants

C) legal cost to evict

Only if the tenants move and have done no additional damages, paid

all of their rent and I had no extra out of pocket expenses, then the seller could reclaim those funds held in escrow. I believe that $5,000 to $!0,000 is a fair amount to hold over...Depending of the value of the property. --47.156.xx.xx

Do what Deanna said. I had relatives move into an apartment as the tenant was moving out. I had six empties due to the closure of a GM plant so I let them stay. They have been marginal tenants but I count the number of potential empty months for the 15 years they have been there and I have made money on them and that unit. So you could hand them a lease and make money on them if you want to. I can't imagine living next to a tenant. It's like being at work all the time. --73.178.xxx.xx

It sounds like you are under contract because you are doing an inspection tomorrow. Otherwise you could have the seller deal with the present tenant. It sounds like the owner filled the unit to make it look good that its rented..

HOWEVER, since there is no lease AND it sounds like you want the tenant gone.

Maybe give tenant 45 days to 60 days to leave. The other options is to offer Cash for Keys and if they are out in 3 days once you are closed on the property. Plus you make certain requirements. No damages, broom clean no debris left behind, etc then tenant will be paint x amount of dollars.

The other option IF you find damages when you do the inspection then use it to negotiate a lower price. Check each room to make sure there are no damages. If you see any then address it with any damages to the ceiling, walls, windows, doors, flooring, etc. --99.56.xx.xx

I say stay in control and nip it in the bud because they are probably freeloaders.

No need to be shy or to make up stories.

"Joe, As of tomorrow I will be the new owner and want the house empty. Do you have a place you can go? (gotta ge them thinking about alternatives first) Can you be out this weekend?"

Optional: This has worked for me because it makes me a good guy, giving them money. "I'll give you $300 if you are out by _____ and leave the place undamaged." (don't bother talking about cleaning. They won't clean.)
