When a tenant starts to be an issue, whether long or short term, are you quick to pull the trigger on sending a Notice To Quit or do you try to reason with them first? I have always been quick to serve new tenants because the sherif leaves a lasting impression and they learn to follow the rules quickly. With longer term tenants I have more patience but it's wearing thin lately. For twelve bucks I think I should just let the NTQ do the talking. --71.10.xxx.xxx |

I too struggle with this issue. I am also quick to serve someone. I will say that it does send a strong message & cooperation is more likely after a filing. However it does do permanent damage to the relationship.
When I look back on folks who I have 'driven out', I rarely regret it AFTER I have filled the vacancy with upgraded tenants. --108.51.xxx.xxx |

$50.00 is peanuts. Here to get the Constable to serve papers cost $247.00. And to file for a default judgment, cost another $50.00. Ask me how I know,...I was in court today evicting my only deadbeat. Judge gave them 7 days to move out. --68.63.xxx.xxx |

We're quick to give them written notice, but we do it nicely. If no results we go full-on eviction.
My lease is clear: it spells out good resident behavior. We simply copy the page with the rule they are breaking, they initialed EVERY page plus some important clauses, we circle the appropriate section in blue highlighter, and give them 3 or 7 days to correct.
I also use a Drive By letter with standard issues we can simply checkmark. The letter instructs them to send us a photo showing the (trash has been cleaned up) within 7 days or we will clean it for $100.
My court likes to see that we tried to deal with them professionaly before evicting.
Rents: Zero Tolerance on lates WORKS! We send a 3 day text, almost ALL pay, we file on the few that don't.
At today's weekly meeting, only ONE got a 3 day text for missing Friday's weekly payment. ALL OTHERS are paid up.ZT works.

To be clear, there is a formal "Notice to Quit" that requires proper service via sheriff/constable, or just a simple lease violation letter that costs 50 cents to drop in the mail. Or a text/email.
We go the least expensive route first.
Text: "Hey Joe (cue Jimi Hendrix riff), saw a car parked on the lawn today. Here's a picture I took (attach picture of car to text). The owners don't like that and we agreed in our lease that this wouldn't happen. If I see it again I'll have to charge you the $25 fee listed in the lease. Thanks for taking care of it."
If we see the car again, I mail the letter.
"Joe, here's another picture of the car we saw on the lawn and this is the second time we've observed it. A $25 fee is now due with your next rent payment."
If we see the car again and/or no payment is received, we do what Brad does...mail the lease with highlighted portion along with a "72 hours to comply"...and if they fail, we file eviction. No formal Notice to Quit required by Missouri, and I've already given 2 notices. If your state requires it, you might do the notice to quit just before taking this final step of filing.
THREE STRIKES:
1) informal "nice but firm guy" notice
2) formal "just the facts" notice

I start with a 72 hour notice to cure whatever the problem is.
I give the "pay or get evicted" notice on day five for late rent. If I ever have to serve a late notice a third time, they get their 30 day notice to vacate.... which quickly turns into an eviction if the rent still isn't paid.
If ever a tenant becomes difficult and unreasonable to deal with, they are given their notice to vacate. I'm just not going to deal with their bad behavior or craziness. --72.35.xxx.xx |

I leap on them early. I feel the sooner I make it clear who rules the better.
I send a 10 day pay or quit at day 3 to 6 depending on the day of the week. I do not issue a 10 day on Wed or Thur as I would be due to file on Sat or Sun. I will wait until Friday for a file on Monday. This gives a few days to just text reminders and not pay for service, which is $25.
For breech of Lease, I post and mail a notice. I have not ever had to evict for cause or serve a notice. However, I have filed 3 times for Emergency Possession based on Tenant waste and once for a Tenant threatening my husband with bodily harm. Emergency Possession hearings occur within 48 hours of filing and I have been granted immediate possession each time. --216.23.xxx.xx |
