My tenants built illegal additions on to my homes. No permits. Nothing is up to code. Must be demolished. Tenants taking to long or stalling time to cure city violations. City is now taking me to Ordinance board of Appeals in 2 weeks. Demolition crew will cost me 5-6 thousand. Should I evict them or sew them or both? --99.203.x.xx |

A lot depends on what's in your lease agreement regarding the subject of alterations and changes to the rental. If they violated the terms of the agreement, you could do both.
My agreement does not allow such a thing.
For the city, you are responsible for demolishing the addition, or pulling a permit, pay fines and bring it up to code.
How did you find out what was going on behind your back?

If you were in Los Angeles, the eviction court would say your tenant added value and you can't evict because the addition has no permits.
In my case, the General Administrator is a liar. The head of the Housing department had a nervous break down and is receiving full pay and a 5 year vacation so no one is running the show. When you try to resolve the same types of issues, the City Attorney lends 200 of his best lawyers to defend the city against a grieving landlord. Here you can't win.
So in my case, I would raise the rent to $5,000 a month, then evict for non payment. I'd never be able to evict on cause...like an illegal addition. --47.156.xx.xx |
