Eviction notice served July 5 for end of August lease termination. NH Law allows for eviction for substantial damages.

Their car is leaking fluids and driveway is a multi car sized mess. Already tried to address they with them.

Tenant emails that she has rights and cant find anyplace to move and child MUST remain in this school system.

Guess I need to get multiple quotes about the damages so judge will rule in my favor.

"I have rights" , "my Lawyer...." and "I will sue" are my favorite lines from no nothing tenants.

If it gets to that point I doubt if a NH judge would actually rule for them.....but ya never know in this changing world.

The adults parents have to manage this, not the landlord. There may be a group in your area that can assist them in organizing the new place, sounds like manager needsto bill for the damage as it occurs - added to next rent cycle. --76.188.xxx.xx

The parent might prefer that school system, but every school system in NH educates autistic children in the least restrictive environment following federal laws and is required to pay for out of district placement if they can not meet the child’s needs. That would not be a good enough reason to evict someone here .If you want to send her over the edge at the hearing wait till she tells the judge she needs more time to move and tell her if she cant keep an apartment because they are being evicted maybe someone from child services should be taking the child for the childs safety since it looks like they will be homeless. --72.231.xxx.xxx

That woukdnt get an eviction in ontario.

The tenant would be given multiple chances to remedy and they only have to remedy for a short period then the process starts fresh.

In addition an adjudicator can simply follow one of the many "interpretation guidelines" in the tenancies act allowing them to simply say an eviction would cause undue hardship to the tenant, and cancel the eviction.

The car must need some kind of major work to fix the oil leak. I had two leakers in the driveway recently and it ended up as a ruined upstairs carpet which cost $2100 to replace when they moved out. I might ask a mechanic friend or neighbor how much he might charge to fix that and then see if I could get the tenant to give up the car for a couple days to get it fixed. Not sure who will pay. Maybe the tenant can pay over time. You are not going to get her out and this is a more business like way to handle it. With an autistic kid she has one nerve left and you are getting on it. WOW its amazing that people especially tenants thinks it OK for the car to leak oil and not do a thing to repair the car or have the car towed away. THEN scream "I have rights" .

NH law does require prior proper notice to give tenants a chance to make amends before you can go to eviction.

I don't see anything about Autism in your post. My child is on the Autism spectrum, and her disability has never made oil leak from my car. So I really don't see any connection. Are you evicting, or is the lease terminating the end of August and you are not renewing? One is much more clean-cut than the other.

I suspect this may be a lower cost rental? People with a disability in the family often have extra expenses than others. (medication, therapy, whatever) On a tight budget, it can be "impossible" to come up with $ for car repairs. (Been there. I've had to just let it leak for a while myself.) And some leaks are harder/more $ to fix than others. Not trying to excuse them, just possible reason. Oil stains are common in lower cost neighborhoods I have been in. How important is it, really? Are there any other problems?

With that said: It's not expensive to park over cardboard and make an effort to keep it clean. There are good products on the market for cleaning this up. Has anyone tried to wash it away? I have heard of charities that help with car repairs, or general financial assistance - if $ is the issue. Perhaps you/they can find one in your area. It might be a GOOD thing if they prioritize paying rent over fixing the car, and are otherwise good tenants.

I realize you have already given notice, so some of what I said may just be helpful thoughts for another time or another person. I remember Jeffrey saying he had a list of local charities to direct a tenant to if they are in an urgent need of assistance - if it helps an otherwise decent tenant to stay longer.

The tenant ..... rather than do all of the things mentioned above seems to just ignore the issue. I have placed refrigerator boxes in their parking space and they go missing & I left kitty litter in a pail with a scoop for them to use and it just sits there.

Never in my 20 years of owning this particular property have I seen such a negligent mess that will cause long term damage that is very expensive.

Other tenants will track it into their carpeted units.

Saying she is looking and cant find anything ........but she doesn't have to move because of her autistic child simply explains they are called .........tenants . --24.34.xx.xxx

Unless you have given her written permission to park in the driveway she does not have a right. Explain if the car is in the driveway it will be towed. If you did give written permission does it state it cant leak oil. No matter just tell her you will tow it asap if parked on your property. When I was a student, I had an oil leak that I could not afford to repair. I bought two large roasting pans for a few dollars, and carefully placed one on the garage floor and used caulk to fix it in place. The second pan, I simply nested in the on that was glued down -- so I could easily remove it and pour the oil into a container that Auto Zone recycled.

Fact that I couldn't fix the leak right away was no reason to mess up the garage floor!

Just for my own satisfaction I’ll go back to their previois residence for a look and call the previous LL to compare notes.
