Our trash pick up used to be free but now we have to pay for it every three months. Our tenants are not paying for trash pick up. I have asked them many times to pay for the service, I don't know how they are disposing the trash now . My question is would it be legal to pay for their trash and subtract it from their deposit? My lease says tenants are responsible for all utilities,. --208.54.xx.xxx

You say you don't know how they are getting rid of it now,you need to do an inspection,it may be piling up in the garage or basement.The other possibility is they have access to a dumpster at there job and get rid of it there but you need to know it is not piling up somewhere --72.231.xxx.xxx

It's possible they are putting it out on trash day and it's being picked up and your property will get a bill. Where are u in Missouri? County? Some areas have mandatory trash and can be billed as a lien on the property.

I would pay for it until the leases need to be renewed. If month to month. Send notice of change of terms. Rent goes up to cover expense and tenant benefits. --99.203.xx.xx

Trash disposal is something I as the landlord will always take care of as I do not want trash backed up on property. Agreed with Johnny, have rent at a rate that covers your cost. If you do not spell it out in the lease that unpaid trash utility bills will come out of security deposit, it is not legal to withdraw it. --172.58.xx.xxx

Bill in the next rent cycle, I don't know why so many do not understand how this works. Add the unpaid utility fee and send them a rent bill, apply the account payment to the old fees and send another bill for the rent shortage, if unpaid next month you follow your local/state tenant laws and based on your court protocol you begin to evict using the correct paperwork and timing you understood before you rented your first unit, always a good idea to stay up-2-date on tenant laws from your county/city as well as the state laws. --76.188.xxx.xx

On my lease I have a section where utilities listed and I check which they are responsible for and note which I am responsible for. I have the phone numbers listed for the utilities they are responsible for. In the security deposit section, it lists all of the possible deductions from security deposit including damage, missing items, etc., as well as unpaid utility bills (and I spell those out to make it perfectly clear). Sounds like when your tenants first moved in, trash services weren’t in the picture. Could also meet with them and have them sign an addendum that tenant is responsible for trash service and that any unpaid costs could be deducted from SD. I am really seeing the value of having things so spelled out in the the lease that there is zero room for interpretation (as many here rightfully preach). In my area, you can go to the transfer site and for $2 a bag dispose of your trash. Recyclables are free. I don't require trash pickup, tenants can take it if they want (like I do) or get trash pickup. That is their choice, as long as it is not piling up or causing an issue. Some may use their work or other dumpster I don't care as long as it isn't causing a problem to me or other tenants

Personally, $8 a month for trash I dump compared to $30 for pickup, is a savings for me. --108.44.xx.xxx

If you have a lease, and it does not specify anything about trash pickup or cost (since it was free) you will have to wait until the next signing/renewal to change that. I don't think taking it out of the deposit is the way to go... it lowers the deposit that is available for damages and (since it was free) it was considered part of the rent.

I can tell you what they are doing with it. They are bagging it up (if you're lucky) and placing it in the shed or garage. Once it's piled high enough, they will midnight move on you. Ask me how I know this....

I have one house that for some reason the tenants never ordered trash service. After tenant #2 did this, I ordered trash service for the house. I raised the rent $25/month and advertised it as trash service included. Haven't had an issue since. I suggest you do the same thing. --98.175.xxx.xxx

I do it like Vee does it. When tenant makes a payment, that money gets applied to current rent LAST. If they owe any other money (late fees, pet fees, trash fees, etc), their payment is applied to those things first. Whatever is leftover goes toward their current rent. If they’re short, then you treat them however you would normally treat anybody who shorts you on the rent. Spell it out in your lease. Think. Do you honestly believe they are putting nasty bags of trash in their car and driving to the landfill to pay $2 a bag?

GO now and I will betcha a milkshake your basement or garage or shed is FULL of trash.

Remedy: charge them to remove this trash, like $5 per bag so they feel it.

(ANOTHER sad case of Wimpy-Lease-itis!) My lesae is clear: increases in taxes, fees, utilities, insurance, etc are not controlled by management and will be added to the rent. Booyah!

Now write up that clause with the title STANDARD POLICY at the top. Add the fee to their rent. I predict zero complaints.

Our oddest tenants ever chose to take their garbage to the transfer center, 12 miles from their own home, rather than pay a local hauler. We think that the husband did that as a way to get away from his somewhat mentally disturbed wife and spoiled kids for a few hours on Saturday. One summer, he was traveling a lot for work. He left grass clippings in black plastic bags on the south side of the house for three weeks - the neighbors called us to say that they were afraid that a gas grill was leaking, from the odor. It was NASTY.

I think that we will be forced to handle trash payment ourselves soon, as the normally laid-back HOA has started to get quotes from haulers to do the entire neighborhood. We currently have 4 different haulers pounding the daylights out of the private streets! --71.175.xxx.xx
