Tenant called BOH on a common hallway lite on their floor. It's wired to their meter, it's stated in their lease. We didn't think 2 family required a house meter. We got cited for co mingling. Do you

Yes, you need a separate meter. However, you can allow co-mingling of electric if the unit is rented "including utilities".

Did tenant call because of eviction notice? If so, Retaliation is usually handled "sympathetically" by the BOH. In my city, when I emphasize that the tenant is Retaliating, they do a "go slow" when handling the tenant complaint and allow me lots of time to resolve. --73.16.xxx.x

Unfortunately unless the common hallway light is in their exclusive control (switch in their unit, no photo eye or motion sensor) you will need to correct this issue. Depending upon how hard the BOH & or tenant want to push this you might end up paying their electric bill. I personally know of 1 case up my way where an elderly LL ended up paying for 2+ years worth of electric bills because a light with a pull chain was on a tenant's meter.

To avoid this issue in my 2 units I installed 2 complete sets of exterior lights, 2 sets of basement lights, 2 sets of stairway lights & 2 sets of common area hardwired SDs / COs. Each of these except SDs & COs are controlled by switches within the individual units. It's also written into the rental agreement. In most cases I find the payback period is 18 months or less.

Perhaps you could temporarily install some battery powered LED lights that are activated by either motion or photo electric eyes.

BOH,board of health? in my area that complaint would go to the power company and they do an investigation,i am in the middle of one now,power company determined it is costing my tenant .80 cents per month,i can either put it on the correct meter and prove it with a bill from an electrician or have every tenant in that unit sign something acknowledging the problem and that they are being compensated for it so my electrician is due any day now.Fortunately no common hallway or I would need a house meter or have any tenant sign acknowledging that it is on there meter and in that scenario I would have the tenant sign a form --72.231.xxx.xxx

In this 2 family only one apt was occupied for the time they have been there so all use was theirs. Steve the house is wired like that except for 2 common lights. House was owned by an electrician. No eviction currently, just out of the blue. They are paying below market rent. But you know, dam if they are going to pay that extra cents for a hallway light they are using. If you put in a LED bulb the annual usage is about 3bux, be sure that is shown in the lease somewhere that month 12 is reduced 3 bux but the normal rate goes again for 11 months. --76.188.xxx.xx

If they were the only tenant then all use was theirs, no one else got to benefit from it. Just like a single family house that might have dusk to dawn light outside. In NY, if the amount of electricity used is minimal, you can just reach an agreement with the tenants about payment. I have in my lease that tenants will pay as long as the 'minimal use' definition is met. Maybe MA law allows for something similar?

Minimal use is defined as:

• less than 10% of the total monthly consumption measured on the meter,

based on the average monthly consumption for the preceding 12 months;

or

• 75 kilowatt hours per month of electricity; five therms per month of gas,

or one pound per hour per month of steam;

I have more than one 2 family where there is an upstairs hallway w/ a switch at the bottom of the stairs for the 2fl tenant and a 1fl hallway w/ switch for the 1fl tenant. My electrician told me it's all good as long as each unit has a separate light/ switch for their corresponding areas (ike the 2fl meter lights the attic and the 1fl unit lights the basement stairs). Sure the 1fl tenant could turn on the 2fl light that lights up the stairs, instead of the light that is over their entry.

Bet it's not clear to me that the light in question would light up an area for another unit. why would the other tenant be up in that hallway?

In the house I had a fire, I put electric heat in a hallway that a 2fl tenant has exclusive use of to keep pipes from freezing and installed a house meter/ heat for the utility rm where all the water heaters are located.

In my other 3 family my meter has the hallway lights for 3 levels and the exterior light which I put on a timer switch.
