Tenant lease ended May 31. Lease states if tenant stays past lease expiration, lease converts to MTM with all rules in place. We need to terminate tenancy for possession. But they called BOH. What is the state law on retaliation in regards to terminating tenancy? thanks --74.104.xxx.xxx

If they actually called the BOH & make a claim, any attempt to evict within 6 months except for non payment will most likely be construed as retaliatory. Unless you can prove that their termination is not the result of their complaint you will be stuck for the next 6 months.

FYI if they fall behind with their rent immediately serve them with a 14 day notice. Since they are now MTM & not term tenants they only have the right to cure a 14 day notice once in a 12 month period. They must pay in full including any constable fees, etc within 10 days of receiving the 14 day notice. --72.93.xxx.xxx

Bet, I hit submit too soon.

The reason you should serve them a 14 day ASAP is so the next time you serve them a 14 day, you do not have to allow them to pay up to reinstate their tenancy. --72.93.xxx.xxx

Often they call the board of health or building department so be ready for any minor violations. No loose or missing tiles but the tiles do not have to match. No loose or missing plaster or raw plaster again the colour does not have to match. All receptacles must have covers so no exposed wiring. All the electrical, heating, plumbing including the hot water must work. All the door locks including the bathroom door must be able to lock. Usually any minor violations can be cleared with a few hours then it is over. For health issue no garbage or unsanitary conditions where it is up to the tenant to keep the rental clean. Often it is better to join a landlords association where Google to find one as situations like this come up sometimes where can get help how to resolve. Most town or city halls book on all the building codes where some jurisdictions can downloaded on line. Had a problem with a tenant who complained about mold in the bathroom where the building inspector was uncooperative where went to head building inspector where the tenant was washing clothes in the bathtub. There are commercial front load washing machines and commercial coin dryers in the building where the tenant did not want to pay for laundry. The head building inspector agreed with me that the bathtub was not meant for doing laundry end of story for tenant. New tenants moved no problem ever. --147.194.xxx.xx
