Hi,

I got a copy of "abstract of judgement". I was told by two collection agencies that they don't do an individual collection work. They only do with huge units (more than 400). And they told me the chance to get the back rent pay back($6200) to me is zero.

The evicted tenant already moved in to a luxury apartment, I called the company, they said when the time they applied, the eviction notice was not in their record. (The previous mgt company did not report them, they moved out on the day of the hearing, so the case was dismissed, and only one month rent, so the security deposit covered it.)

The attorney I talked to charge $250.00 to write the letter and to call the tenant, but no result (to collect) the money or not. If the ex-evicted tenant did not care about the law, how a letter from an attorney will make any impact at all.

Could you share with me, how or if I ever going get the judgement back? How do I report their eviction to the credit bureau, so it will list on their record, if others concern their eviction?

I have no idea how Texas works but here, I could send the sheriff to knock on the door, inventory all their personal items and sell them at public sale. Don't know any numbers but I'd imagine most of the sales don't happen ... it's just a the final wake up call to pay up.

The three credit bureaus pick up the judgments automatically here ... probably depends how they are recorded in your area. --72.70.xxx.xx

Sorry, the state of Texas does not do garnishments as other states do.

What we do have is a landlord friendly statute that allows for eviction very quickly, typically less than 21 days from posting the notice to sheriff set-out. I don't know the situation that led to $6200 in back rent, but I'l guess that that was more than one month rent. The lesson here is to post the notice within a couple of days when they are late and then proceed immediately with eviction filing if they don't pay within the required 3 day otherwise you will keep bleeding money.

You can file the judgement here on Mr. Landlord which I would suggest you do. However, it is unlikely you will ever see a penny of that unless your former tenant tries to buy a house at some point in the future. --50.26.xx.xxx

Does this person mean to "sell my property"? just because an eviction I had?
