Help ,, I have 2 sf homes offered at the local county (ERIE) NY to be auctioned for past due property taxes. I have read conflicting stories regarding existing liens by creditors.
The county does not guarantee private lien free status only local gov. does anyone have a good mentor source maybe on line I can research ? Thanks bob --98.5.xxx.xxx |

Call a real estate attorney it will be worth your cost to find out what liens you will be responsible for once title is in your name. If the owner has any time to redeem the property. If you sold the property should you do a quiet title action on it. In other states the rules can and may be different with county tax auctions. --99.56.xx.xx |

If the county did the foreclosure properly and named and notified anyone holding a mortgage or judgment against the house then it will be wiped out,if they did not do it correctly then it will not be wiped out and will remain against the house.County and city attorneys have a very bad reputation for doing these foreclosures correctly and in most cases title companies will not even issue a title policy for 2 years so be aware you may have a hard time selling the property or refinancing it.If you are really interested in just these 2 properties you may want a title company to do a search and tell you what is there against the property to begin with and if they will issue a title policy --72.231.xxx.xxx |
