State Specific Question About: ILLINOIS (IL)
Can you charge extra security deposit for the emotional support/comfort animals? A possible future tenant has 2 of these and commented oh, thats okay even though they are my support pets.
Not sure what the regulation is on this in Illinois. Thanks,

No. No extra security deposit and no extra pet fees. Federal law.
Tenant must provide proof in the form of a letter from a medical professional.

The subject was addressed at a local investor club meeting this past Sunday. Yes, there are federal rules which apply towards renting to those with ESA. The significant problem are these printed medical reports floating freely out on the internet which basically designate any animal to be an ESA. HUD has identified this problem, and in presently in the process of setting standards for licensing these online outfits, and to qualify the animals themselves, before they can be officially designated as an ESA. --99.203.xx.xx |

I don't tell them what they need because they will come up with it.
The law is clear that the only proof is a LETTER OF MEDICAL NECESSITY from a licensed doctor. They are available online so my local Fair Housing office says it must be from a LOCAL doctor with a HISTORY OF TREATING that patient. But know that doctors will hand these out right and left.
We denied "Based on the information provided we cannot allow."
Again, don't teach them how to get around the system.
Check your state law. 19 states, including Calif, now have laws making misrepresentation of a service animal a misdemeanor with fines and even jail time.
