So, three times I have had issues with a tenant having guests implode and/or become nuisances outside the building - while still on the property. Sometimes, this is love-related. A prior time, it was the tenant's son's girlfriend who was drunk/high/vomiting/screaming, so it is not always the Romeo scenario. The last time was a tenant's sister who would sit outside and honk at all hours of the night rather than phone.

The legal team told me at one time that tenants cannot be responsible for their guests behavior, and therefore, I cannot take action. This last time, the legal team said that if the tenant was outside witnessing the disturbance, then they are partially responsible.

My question: Is there any lease clause that addresses this? If so, what does it say? I have a noise clause already, but it does not extend to guests of tenants. What do you all do for this? --69.130.xxx.xxx

Sadly, the other tenants living in the unit do not phone me while this is going on, and with a car outside honking, or loud, they are often gone before police would arrive. I'm about to get new tenants now, and looked over the noise clause and hoped that there might be an addition to it that covered more clearly the responsibility of tenants for their guests. Maybe it is just an impossible thing to prevent. --69.130.xxx.xxx

I don't know why you couldn't have something in the lease that said anything their guests/visitors did would be attributed to them.

I have a clause that makes the tenant responsible for damages that their guests cause. In my duplex, I have a clause that the tenant and guests cannot be a disruption to the other tenant. But there is probably no way to enforce that other than calling the police. Sometimes we can not be responsible for other people's behavior.

I understand not being responsible for other people's behavior - but, in the case of a multi-family rental - one tenant's bad choice of friends can empty the entire multi-plex. Without some bumper guards, tenants can allow their guests to create problems for a landlord with no options for the landlord. Police would laugh at someone who was phoning to report someone honking a horn, or gunning loud engines during night hours. I'm regretting not putting all tenants on a month-to-month lease just to give myself an easy out. Term leases are a nightmare when this sort of thing takes hold.

Most recently, a tenant's guest punched another tenant - and the other tenant didn't phone police, or submit a complaint. Meanwhile, other leases in that complex are coming up for renewal and tenants who have been terrific are going to move. --69.130.xxx.xxx

You can put into your lease that tenants shall be responsible for their visitor's action and/or misconduct and adherence to the rules & regulations obligated by the lease.

Im going through an eviction right now on a woman that brings her drama out into the streets. I get calls from the neighbors about the police being called, men shouting obscenities, and at one time a gun was drawn by a visitor she was fighting with. Children and elderly live in the neighborhood. One of the neighbors found a letter in his yard addressed to her. It was from a man in prison wanting to exchange -you know what - for money. His child got ahold of the letter. The reason that i listed on the eviction paperwork was Disturbing the quiet enjoyment of the neighborhood. That clause is also in her lease. I had the neighbors write out statements and Im ready to go to court on the 30th of this month. Ill let you know how it goes. --76.92.xx.xx
