Someone looked at our rental unit and applied. But they are going to put autistic adults in the unit under their company. No, I think they should rent a house because those people kick and jump badly.

So long as you have a written criteria outlining the qualifications you desire for your rentals, then do a complete background check and find a legitimate reason

CJ, I have written about this before. Search for "group homes". My son has special needs and spent some time in a staffed group home. If you decide to accept this agency, you will need some special lease provisions. Make sure the AGENCY -- not the clients- is the tenant. Make sure the AGENCY is responsible for the cost of repairs (the agency can in turn charge their clients).. Set a schedule for regular inspections in your lease, and bill for repairs as damages occur. A staffed group home will probably be cleaner and better maintained than your typical tenants, as state social workers and client families will be frequent visitors.

Renting to agencies that run group homes can be very profitable for LLs. Plus, you could always decline the agency or raise your rent to compensate for the increased wear and tear. --98.146.xxx.xxx

We do not take co-signers but you are welcome to purchase as a main signer with your bank, Really you can not handle a monthly rental so I do not suggest adopting adult kids before you win the super duper lottery and can afford to deal with police reports, detectives buying drugs on your rear yard, the nurses who sleep thru the smoke detectors, with or without having partners visit them for 7hours. Just say that you only rent to individuals or families that you can garnish from in the event it is necessary. You don't do co-signers, and you don't allow a business to be run from the home.

I am not interested in any of my rental properties becoming group homes. And yes, I've had a few ask about turning one or two of my larger houses into one.

Around here there have been a number of unlicensed group homes recently shut down. Horrible living arrangements for their residents.

CJ: I hope you are very careful with this. I say this because you VERY OFTEN have communication issues with applicants and tenants as you've posted about them here numerous times.

You are denying someone with a disability. You need to be very careful about that. If you deny them because you think it will "cause you stress" or because you say that they will "kick and jump", then be prepared to be sued for denying someone because of their disability.

You need to be very sure that you deny for the proper reason: either the co-signing or the sub-leasing or something very specific. Have your WRITTEN CRITERIA in order.

Again, I say this because you have repeatedly had miscommunication issues in the past. I am very concerned that you are going to tell them "no" because you "don't want to be stressed" or because you don't want them to "kick and jump and confuse the other tenants" like you've said here. Both of those reasons are a lawsuit waiting to happen.

Another note: Parent may be playing the role of a caretaker in someway (another reasonable accommodation that should be permitted) and therefore it may very well not be a sublease situation. If so, you do NOT want to deny a person with a disability from having a parent play the role of caretaker.

All we are saying is that "the applicant has to stay there" might not be acceptable. For example, depending on the situation, it is possible that the person with the disability isn't even able to enter into contracts. Therefore, someone else would HAVE to apply (such as as a co-signer).

I'm saying saying to please be careful. I recommend you consult a lawyer on this one. Simply because, again, you have had communication issues in the past.

If that is the case, just make sure that THAT is the reason you denied them -- that they had a past eviction or no rental history -- and, again, make sure that your WRITTEN CRITERIA specify that those things are required to rent from you.

Be sure to tell them that they are being denied due to a past eviction or poor rental history. Do NOT say that you denied them for the reasons that you stated to us above (that you didn't want the "stress" or were worried about "kicking and jumping").

But if that eviction hadn't been there--would she have been able to DQ this group based on running "business activity" out of the home instead of using it as a residence? Mom has eviction. Daughter lives with mom, but with "Infraction"case

They apply as individual, but they plan to use it for her company.

They are not roommate or b/F friends as most people will assume. They did not tell us anything up front, Other people heard they conversation about get how much money the organization going to pay.

The eviction is the mom, The daughter, business co-owner has no eviction and no rental history (living with mom). The daughter has a job reasonable income, but the daughter said she is the business owner. Both mom and daughter made appointment to view the unit, Mom viewed a couple times.

I believe the mom is the real business owner because daughter has full time job and makes reasonable income.

She told me it is her business activity after I asked questions. I asked question only because she applied. She did not tell us business activity on the application.
