Specific CA question

I have a tenant in a house since the 1990s. They are on a month to month by now. They pay on time.

The wife is losing it, and started complaining about everything. The husband hinted that he is getting tired of this too. She wants renovations but will not cooperate in scheduling: "Today I can't, tomorrow I have a Dr appt, Thursday I have to go shopping, etc"

How do I tell them to move out? Do I need an excuse/reason? What about relocation costs? --99.59.x.xxx

- Deed the house to them? my ass.

- No rent control.

- Rent increases every 12 months.

Send a regular eviction notice, no explanation required?

What about relocation costs? They relocate, it will cost them something. I certainly hope you are not thinking of paying for the movers for them!

BTW: Why do you need the wife's permission/cooperation to do work on the house? If something needs to be taken care of, you should be able to give notice to enter and then do it - whether the tenant is there or not. --68.105.xxx.xxx

Unless you are under control no reason is necessary. You will need to give 60 days notice since they have been there over one year. Give them 60 day notice terminating lease. A simple letter will do it, no reason is needed. Include an offer for damage inspection within 2 weeks of the last day they are to leave.

That's it. Then when they have not vacated on the 61st day, start eviction. Don't accept any rent money after the 60 days are up. --47.157.xxx.xxx

You may be able to turn things around and make something bad turn good. I would have a "take" with the tenants and say that you believe things aren't working out so maybe they should consider moving. This will catch them off guard. They may ask what will it take to let them stay. Then you can plan a schedule and things that you will agree to upgrade. They will have to sign a paper that will allow your workers entry during the week between 9 AM to 4 PM, without fail. You will use your key and their permission to enter will not be needed. You will post on their door weekly schedules which will include a notice to enter.

If they won't agree then let them understand you can't be responsible for any "wanted" repair/upgrade. They will have to pay to have things fixed since you can't agree on entry. All they can do is accept things or move out.... It's now in their hands..not yours....You can breath easier because if they move it's because they can't get along....with the landlord... --47.156.xx.xx

Robert, if i tried any reasoning with my lady it wouldn't work they simply dont think reasonably. A plan like this may work for any reasonably thinking person who got out of sorts. This method would have prolonged my agony and added frustration. I'm the landlord. I run the ship, i have rights too. To Ally: The house is in very good condition. Kitchen, baths and floors will be remodeled once this family is out. I could never get it done with the wife around.

To Coplin: I know about the 60 days, I just don't know about relocation assistance when the LL initiates the rental termination. I'll find out on Monday. Clearly, I don't want to give them any money to move out.

To Ken: I stopped upgrading/renovating with this woman around. I only do repairs, mainly involving water, to protect the house from deteriorating.

I've been modestly raising the rent. The next increase I will up the rent more than usual and see if they get the message.

Fred, typically relocation assistance is mandated in rent controlled areas and you are required to pay it. Since you are NOT rent controlled, you are NOT REQUIRED to pay any of their expenses. However if you want to try cash-for-keys the cash amount is negotiable. Alternatively you could give them a "happy clause" letter. --47.157.xxx.xxx

Tenants have a sell-by date. Yours have expired several years ago.
