State Specific Question About: FLORIDA (FL)

I have a tenant with a very short temper and have decided, after 7 years, that it's time to ask him to leave. However, I'm afraid that he'll ransack my condo. How do I handle this delicate situation? At first he just seemed a little odd, yet he's a brilliant man. Now, though, his health is deteriorating, and he's getting ill-tempered and nasty. Help! --76.108.xxx.xxx

maybe set up an appt. with him to have your realtor come and take a look at the place..or call the visitor an appraiser as you need to re-finance. While there take some pics of the place as it is now.

then drop the bomb on him.

Others may have a better suggestion.

Stop engaging him in a fashion that allows you to experience the nasty. Texts only. If he responds nasty, ignore until tomorrow.

I would send notice to vacate on company letterhead. You could have a constable or process server give it to him.

As far as him destroying your condo, it is what it is. Just keep your interactions with him as close to zero as possible and don't add fuel to his fire. Give

Just did this a few years ago.

Take a lot of before photos to show the current condition of unit.(If you have not done so already)

Send a letter by regular mail with certificate of mailing. Many people will refuse to pickup a certified letter.

Send another letter by certified mail return receipt requested.

Follow all laws about proper notice and notification.

Do not engage in phone conversations after letters are mailed. My problem tenant called me and was obviously recording the call " So you are making us homeless over the lead paint issue? " I hung up, as the property is certified lead free and I refuse to engage a whack job.

Expect damage. That is what it costs to get rid of this problem. Outrageous damage and vandalism? Sue if you can. --157.204.x.x

Oh i had one of those. I gave no reason other than our contract agreement was ending. Repeated that a few dozen times. Never changed the story or gave into the temptation of the truth. I had a tenant with anger issues that did not handle a termination notice well. He used spray paint on the walls to tell us what we could do with that notice. After his tantrum was over there was about 10K in damages. This was an inherited tenant. No harm in letting the local PD be aware of the situation. Once you send the notice , avoid contact. Dealing with this now. It doesn’t pay to be nice. I will be renovating so gave about 70 days notice expecting it will be difficult for them to find a place. Anger issues, police called multiple times, now will lose other tenants and still have to deal with angry tenant for another 5 weeks. J, she left the house faily clean but took revenge by reporting septic tank not working to county. Put in a new system and sold property. One one property in septic but sewer line is at property line.

Back to my angry tenant. She was sooo hurt that i gave her notice. Sooo hurt that i did fear her actions. She couldn't believe that i would reject here. Spent quite a few times on the phone talking her thru "either party could end contract, it just ending, that's all" after three off those i just let her calls go to voice mail. And returned calls after i prepared my words and thoughts.

Yu could raise the rent high enough that he decides it is his idea to move.I have come to the conclusion that I don't have these type problems where tenants intentionally cause damage for a couple reasons,number 1 I don't give them an attitude or act high and mighty just because I own the house and it is just business to me and I don't get friendly with them.,i see a lot of landlords get all personal and argue with the tenants because they care and I think that shows as fear to the tenants and they feel like they can get away with it and if you were friendly with them I really think they are hurt that you would walk away from there friendship which they seemed to take more seriously than the landlord did. --72.231.xxx.xxx

I would first tell the tenant that my insurance agent needs to view the condo, I'm switching carriers. Then have someone with you take picture of the condition of the unit. Use a time/date stamped camera.

Then after you document the condition, give the tenant notice they need to move out asap. Like in 30, 60 or 90 days. Also tell them that you have proof of the good condition, your agents has documented it, and if they cause any damage, they will be held responsible. --47.156.xx.xx
