What are the possible ramifications to Landlord who enters property thought to be vacated?

Tenant gave proper notice of moving EOM. I’m aware they are moving this weeekend and cleaning company coming Monday. I have offered to return prorated rent for turnover four days early. No reply.

Asssuming all goes as planned with move and cleaning (property appears vacated) what might I face if I entered home, began repairs/painting, and changed locks on Tuesday?

Text. They will respond with words like "we'll be out tonight". I'm looking for "We're all done."

"Aware" is not enough. You need their words.

LLs need to gain control of the move out process. It's easy to lose money when raggedy move outs.

Ramifications: by contract it's still in their possession. We wait until they TELL us they are out when we ask, to avoid claims that we stole something.

I second Brad's advice. I've got one like that now...they shut off communication about a week ago...not responding. Fortunately, I have their signed move out letter dated yesterday, and utilities were transferred out of their name effective yesterday. So today I'll text them again asking "All done? We need confirmation to process your security deposit." (give 'em a carrot...ANTICIPATED MONEY!), then I'll go by and peek thru the windows, handyman in tow as a witness. anytime I've got a move out I get them to sign a physical piece of paper stating they've returned possession of the property to me... also says they have given up rights to anything left at the property. Like the others above, I don't guess.

That said, I also don't text. I've been at their kitchen table talking about how and when it's going to happen. I'm usually around at least once during their move asking if they need anything from me. I've got the paper already typed up ready for their signature when they are finished.

I don't have a lot of units and this happens only a handful of times every year so it's not a big deal. This has NOT worked so few times throughout the years, I see no reason to change my move out methods. --72.70.xxx.xx

I've always been able to enter a property after a tenant has told me they have vacated.

If I was unsure my excuse would be neighbors called and reported hearing water running in the house and I needed to address this "emergency" situation.

I would not offer anything until you see the cleaned up place, a lot of tenant remove what they want and leave the cleanup to the landlord - it adds up if you hire furniture carryout, carpet cleaning, walls - ceiling repairs and refinishing to make movein ready or even showable to prospective tenants, I try to refrain from showing until it is really ready, cause the desperate folks come along and pronounce they have family who does all that stuff if you can knock off some rent for 2 months (and they never catch up or cleanup either), so again you have a crummy looking place. Just follow your local and state tenant laws on the timing of returning the deposit. --76.188.xxx.xx

The day before I plan to enter a property that Might Be Vacant, I still post a 24 hour notice to enter, place the day's new's paper next to the posting and take a time stamped dated digital picture. Then I have proof of the notice. The next day I knock, ring the door bell then enter the property. I check to see if the utilities are still on (water, gas, electric, phone and cable).

I do this sometimes wearing a Bullet Proof Vest, carrying a Taser Dart Gun, Pepper Spray and a recording device. I've had squatters call the Police saying a stranger entered their home and tried to Kill, Rape and Steel from them. I also have a copy of my notice posting, a copy of the Property Tax in my name and Grand Deed. --47.156.xx.xx

OP here. I hear what everyone is saying. But haven’t received response to the question.

WHAT ARE THE RAMIFICATIONS?

Moshe (CA) came closest.

From what I’ve gathered, tenant would be entitled to “auctual damages.” Considering they moved out 3 weeks ago, it’s questionable if they could even sue me for a few days rent. But if so, I’m ok with that! Maybe they come by, see my car, call police. Police arrive, I show the deed, they deem it a civil matter. Perhaps they intended for an OOT relative to stay there a few nights (oops, my bad. Here’s $300 cash (signed receipt) for a hotel.)

There will likely be no comms directly with tenant. Have a PM and intend to leave them out of it (what they don’t know, won’t hurt them).
