I received bounced check for the 2nd month. Can't talk to her on phone. Texted me to email her acknowledgment letter, copy of the lease and fees owed because she has some institution to help her to pay the rent.

What should I do?

So this is the first bounced check or the second? Well, you have to wait ten days to file here in NJ but I would go ahead and do it. The agency may show up in court with a check but this could go on for months and NJ doesn't tolerate repeat late payments. Google Truth in Renting and read it. That's the booklet written by the Dept. of Community Affairs in Trenton. Some things in there that are pro landlord now. Must be some politicos bought some rentals. --69.141.xxx.xxx

The problem is that the check was written by her uncle that is sick and supposedly in the hospital. She asked me to give her a letter of the statement of account so she can show that she owes late payment so she can get help through her past father's friends, charities. She has also violated our contract many times by for example having a cat, boyfriend living there 1/2 a time and having a dog, keeping furniture and causing me to get the violation and court summon, smoking in the hall, small damages to hall when she moved in. I just wrote her notice to cease and quit and I'm trying to get paid because I have a tough situation so I want to charge her for late fee and bounced check but I warn her about other charges for violations of the lease if she won't pay these.

Private rental housing providers are not social agency which can lose over $100,000 per year short of the operating costs. Start the eviction ASAP as refuse to accept any more cheques as the cheques will only bounce. If you take the cheque to the bank then certify at the bank the cheque was issued if there is sufficient funds to cover the amount. Once certified or withdrawn then there is sufficient funds. A dollar amount short is all that required to bounce a cheque. The free rent period is only going to get worse. Consider joining a landlords association by going into Google as things may get worse where they will start to contact the building inspector then claim serious building code violations. In future cut them off at pass by running thorough credit checks on all adult applicants. Problem tenants getting evicted is a way of life that is a never ending story as long as they find a rental unit that does not run credit checks on all adult applicants. --72.142.xxx.xxx

Here's what is happening and/or is going to happen. This gal is going to continue to lie to you as long as you continue listening to her. She will try every trick book

from Dead Beat University to stall you, all the while continuing to wreck your house, not pay any rent, violate your lease over and over.

The best part is at the end of it all she's going to call you an "F-ing slumlord" when you do actually get around to evicting her. She will take all the guilt that rightfully belongs to her and try to dump it in your lap.

Do not let that happen. It will ruin you as a land lord.

Evict. Now. Don't wait. You're done with her. It ain't getting any better. Hire a high-octane, flat-fee eviction lawyer who has the personality of a pit bull in court. Pronto. No excuses. Do it right after you get done reading this post. Do not respond to my post. Just call that attorney.

She is a liar. She was supposed to pay (lie #1). She wrote you a bad check (lie # 2). She has violated the lease multiple times (lies # 3, 4, 5, 6, 7....etc).

Now, she wants you to believe a story that "I'm getting help from a charity." That is lie # who-knows-what. She knows you'll let her stay for free as long as she can keep coming up with stories and excuses.

She's a thief. She's stealing from you. Do not believe the words of liars and thieves.

Every day you wait is money lost and damages done. Every day you wait, this problem becomes more YOUR FAULT and less her fault. She has proven herself unworthy of trust. So stop trusting her.

Block her number, block her email, and block her texts. Don't communicate with liars and thieves because their words are worth nothing, zero, zip, zilch.

I have had one instance where a tenant needed temporary help, got it and then was able to continue paying on her own. Two others went from temporary help (Catholic Charities and Social Services) to no help to eviction. I let it drag on way too long. I agree with everyone else here. Start eviction. You can always stop the proceeding- and will probably have to- if she comes up with the money somehow. Next month, repeat. --23.30.xx.xxx

You are all right. I love people, want to help but that doesn't help me in this business and I've been suffering a lot because of it. I'll give her letters, try to get from her proof of what she's texting me and file eviction. I don't know only if I can use as rent additional 200 that is on the rent amount because they have not so good credit and I was advised by the tenant background check to take additional amount from them. She didn't want to pay a lump sum so I added to the lease as regular amount +200 --73.194.xx.xxx

You do the tenant no good by letting her slide. The amount she owes you will just keep increasing.

Our lease specifies cash or money order only after a bounced check. A second bounced check would be followed by eviction. This will not get better.

We post on the pay or quit on the first day allowed and the eviction the first day possible. Otherwise we are a charity and I don’t give charity to tenants. It’s a business arrangement.

Time to cut your losses and move on. This tenant will only cost you more and more money. Especially if other tenants move because of this one. --64.222.xxx.xx
