Here is a question regarding the filing for the eviction.

Both tenants signed in the same lease (one lease).

So, when I file the eviction to the pct court, do I file both of them in one eviction (pay one eviction), or I file on each one of them ( pay two evictions).

Could you give me your input today? It will be my first time to file it.

Since I am not in TX I can only tell you how NC handles it. If we have two tenants (related or not) they are joint and several. The eviction filing includes both names and addresses on separate lines. They are both served notices.

The only difference for us when there are multiple defendants is the filing fee is approximately $50 for each additional defendant.

You should be able to download the forms online from your county courthouse and it should include instructions. If not you can call the small claims division at your county courthouse and they will direct you. --71.75.xx.xx

I had 3 tenants on same lease and just had to file ONE small claims and it was same judgement for all 3. So eviction would be same. You’re not trying to get each out of a different house, it’s same house they live together in so it’s ONE eviction. --173.26.xx.xxx

Here it is one filing but additional defendant costs an extra 7bux, even if married - cause by law the one not named could stay and have the other as a guest and you would need to start from the beginning properly. --76.188.xxx.xx
