My Aunt has a house and guesthouse on same property - (one acre). The first tenants Husband/Wife (contract 1 year, late 2 times, did not want to sign contract for another year, want month to month now) rent the 2-bedroom house in the front of the property and The second tenant Widowed Woman/Nurse (contract for 1 year, has lived here 6 months, always pays early by 1 week) rents the guesthouse (1 bedroom) in the back of the property. Each unit has their own yard, carport and mailbox w/dividing gate. The woman who rents guesthouse spoke with me about the tenant in the front unit (Man) who goes outside when she gets back from work and tells her if he weren't married he would ask her out or that if she were interested they could meet at a motel. She just walks away and She didn't want to tell her son (marine) he would definitely beat this guy up. Wants to know if we can speak with this tenant (he gives her the creeps) to leave her alone. Lately, my neighbor informed me that there are two women coming around asking if he lives at that address and they said they don't know and they noticed three more people moved in the home 2 months ago that were not there before. Just did a walk thru three months ago and only couple is there. My neighbors are good lookouts for my aunts home, they were very good friends with my uncle that passed away and they never give any information out. I am going to speak with my aunt about this, so I am going to give notice and do another walk-thru and since they did not want to sign another year and only want month to month, talk to them about not harassing the tenant in the guesthouse and if they deny it, give them a 60-day notice to move. What advice or recommendations from your experience as landlords to implement in this situation and I have learned a lot on this forum, now that I any helping my older relatives with some of their home rentals. 1. I do not recommend that your tenant's Marine son beat this guy up.
2. One clear approach to the problem is for landlady to mind her own business. I probably won't solve the problem, but she has no obligation in this matter.
3. An alternative approach is for landlady to write to the tenants in the house telling THEM (not just him) that the tenant in the guesthouse has complained and that further disruption of the gentlemanly relationship among tenants can result in landlord action. This approach has the following attributes:
a. the letter might go to the wife.
b. tenants may be embarrassed.
c. should anything happen in the future, landlady has proof that she attempted to provide a quietly enjoyable environment for the tenant in the guesthouse.

As Moshe said, it isn't the landlord's problem. If this guy is harassing the women, she needs to report to police. They each have their own "property" so he should not be on hers and you might send notice of this (or not). If he shouts over the fence, there is nothing you can do as the landlord.
Not sure in the tenant friendly state of CA, but here, I would give notice of termination of tenancy at the end of the lease to the creep, because I would not want to deal with him and would not want the good tenant to leave. --96.236.xx.xx |

I would not get involved. Let the police handle this.
However, next time the tenant is late, I would file a 3 day notice, refuse to accept rent or partial rent and start eviction for not paying rent.

I'm not going to referee the relationship between two tenants, but I would be all over the unauthorized tenants moving in.
That tenant wanted a month to month, so you can just give the whole group notice to move out and have your vacancy at a good time of year.

The only thing your Aunt needs to do is make sure the husband and wife stay month-to-month. That way if things get out of hand, she can terminate. Probably a good idea to put the single woman on month-to-month too. That way, she's covered and can throw out one or both tenants.
This is the most I as a landlord would get involved. I would also let the single woman know that she must handle it, file a police report or restraining order if it gets too out of hand.
Your aunt can't possibly know the whole story, or if what she's been told is true. Maybe the husband and wife are too loud and other lady doesn't like it. Maybe they have the garage and other lady wants to use it. Maybe single lady wants to move her daughter's family into the big house and the family is in the way. There are rules and laws that deal with this type of problem. Here in Los Angeles with a multi-family property and landlord must get involved when TWO OTHER TENANTS are affected by a Third tenants actions.
When only one tenant is affected by another tenant, a landlord should allow these two tenants to work it out on their own. Of course this is when the problem isn't dangerous or life threatening.
Case in point. An upstairs tenant was allowing her children to run around the unit at night waking up the downstairs tenants. So I asked the downstairs tenants to keep a log on her calendar of the dates and times this occurred. I sent an email to the downstairs tenants outlining our conversation and what I asked them to do.
Six months passed and the downstairs tenants began to complain again. I asked if they kept a noise log. They said no they hadn't. I then told these tenants to talk to the upstairs tenants about the issue. Not when they are woken up at 3 AM, but during the day like when they go outside to their car or throw out trash. I wrote another email to the downstairs tenants about the same thing. Then a month went by and the downstairs tenant was so mad that they got woken up. They hadn't talked to the upstairs tenants yet. I then advised the downstairs tenants to call the police when it happens again. I gave them the police front desk and dispatch numbers. I followed up with another email form my files.
Then I had a talk with the upstairs tenants. After the lower tenants didn't try to do anything about this or work it out.
Then Housing called me into a meeting. I as the landlord did nothing to resolve the noise issues. I laughed. I went the the hearing and told the Administrator, Housing Officer and so called judge that I will speak, but only after they put their phones down, stop reading papers and talking with each other. I wanted their full attention. I presented my email outlining the issue with the downstairs tenants and an email I sent to the upstairs tenants asking them to keep records, talk with one another or enlist the aid of the police. After than moment it was out of my hands. It never was in my hands because it was between the two of them and not me.
Only because I documented the events and was not responsible for making them deal with "life's issues", I wasn't found responsible for the noise issue.
Only after these two tenants began to deal with each other, I then installed sound proofing between the two units at a cost of $3,000. --47.156.xx.xx |
