Here is something I read recently about your question. Of course check your own state laws.

"The landlord may be able to have an emotional support animal removed if it poses a direct threat to others or disrupts the ability of other tenants to enjoy their dwelling. This is not a loophole to get rid of emotional support animals because someone doesn't like living in a complex with a pet next door. It is meant to give a legal remedy if the emotional support animal proves to be a nuisance, say by barking incessantly through the night so that other tenants cannot sleep peacefully in their own homes, or by the tenant refusing to clean up after their pet, posing a health risk to others." --173.239.xxx.xx

Should be no trouble to get the dog back to training, peaceful enjoyment of living space/s, but your question is partly about therapy which is a pet, have your tenant describe in writing what is this animal - nothing fancy, you need to brush up on handling animals. Anyway if bowser can't be controlled by the animal person then sadly something has to give, animal owner always needs to cleanup the exhaust. --76.188.xxx.xx

The law says you can not charge or regect an applicant based on a medical disability or the need for a medically required device which an ESA is considered. However, that does not free the Tenant of being a responsible pet owner. Handle this like you would handle any other nuisance pet. Send them written warnings/documentation and if the problem is not corrected, bill them accordingly or serve a cure or quit notice. My front tenant has lived in the property for 40 years. He takes care of the lawn, flowers and scrubs. This apartment building has the nicest looking grounds. In come a new tenant and get a cat, then girlfriend and then dog. All without permission. The dog barks non-stop all day when no one is at home. When I enter the unit to do scheduled work, the dog wants to attack me. The dog hates men, the tenants are two women (one unknown to me).

We had asked the women not to allow the dog on the lawn since my front tenant pulls weeds every day and treats the front lawn as an extension of his apartment. He has cats that play on the lawn all day.

The tenants didn't comply and allowed their dog to pee, poop and tear up the grass with it's paws. Now my front tenant is having a major problem.

So this case went to court. The dog is now an emotional support dog for the unknown guest, not the tenant. The lease states no pets, they have a cat and dog. Only because I had video and a report from animal control that pooping on a lawn and not picking up after it is a violation, the tenant were warned. The next time they refuse to pick up after their pet, I could have "it" removed or evict.

The tenants then purchased a home and moved away. --47.156.xx.xx

The animal people have always had to clean up the exhaust, but this is a trick question because the question contains a emotional plus a therapy dog - totally different things and treated totally different, therapy is a pet - they are pets which pet owner takes to school or nursing home to visit but is not going to offer the owner any therapy therefore for us landlords that is a pet... --76.188.xxx.xx
