That depends. What is your normal process? We normally don't email applications, we have applications available at the showing. If someone asked us to email an application, we would prescreen them and offer a showing. To us, it doesn't make much sense to have someone apply to a rental they haven't even looked at. If it isn't your normal process to email applications, then it is understandable that you might forget to email one after a request. --208.74.xxx.xxx |

You need to avoid even the appearance of illegal discrimination. That's the real problem.

Like Cat, I do not email applications. I have them available at the showings.
When someone insists on getting an application without having seen the place, I get a bit more cautious. Why would someone pay an application fee without first seeing the place? I have had someone explain that she needs time to put the information together, so she wants the app in advance and will hand it in if she likes the place at the time of the showing. Makes sense, but I still do not want to give it out before showing the place.

Mike45, I give out an app through email, only if the pre-screen gets to a point where they ask about it or the process, then I offer it. Some ask to have it snail mailed, so I oblige. Never hear back from those folks.
I don't collect an app fee until I get the app back.
Most folks get an app at the showing.

We START with the app - before giving out the lockbox code.
We also have them at Open Houses.

I don't see or talk to a prospective tenant until they answer my pre-screening questions. If they do (most don't) we move on to showing the apartment. If they request an app I will send it to them but I'm not doing anything with it until they see the space and want to turn it in. --50.82.xxx.xx |

To clarify,
If you promised to send an app and did not you could accused of discrimination. If you rent to someone else before providing the app they could make a case against you.
