I have a Agency renting my apartment and need suggestions on how to word the lease. The Agency is renting the unit on behalf of their client. Should the Agency be the “tenant” and the client they are renting it for be the “occupant”? Or should they both be co-tenants — “Acme Widgets & Jon Doe”? --76.238.xxx.xxx

The agency is the tenant. Make the agncy responsible for all rent, damage payments, etc. Let the aency worry about collecting from their client. You may want to leave the occupant blank. When my son living in a group home, they would move clients around due to incompatibility, some clients could not climb stairs, etc. --98.146.xxx.xxx

It boils down to WHO PAYS THE RENT and WHO WILL I GO AFTER for unpaid rent and repairs.

We rent to the agency.

But be aware some agencies will not put their name on the lease because they know things can go sour.

Like Rathdrumgal says, sometimes the occupants do not last long.

@Rathdrum — It didn’t occur to me that the occupant would change, but I can do an addendum if that happens?

The agency is paying the rent & gave me a check yesterday for the deposit. The caseworker will sign the m2m on behalf of the agency. I haven’t met the client yet. This is her last year of high school and she has aged out of the foster care system. The caseworker said they check on her once per week. --166.170.xx.xx

Mick, some folks are giving you good advice here. Make the Agency the tenant. Those are the folks who have the money. List the residents as "other authorized occupants."

If the Agency refuses to be made the tenant...there's your sign that this is not a deal you want to take part in. They know their "clients" are flakes and they want to shift the burden to you. --173.17.xx.xx

When I've had corporate leases the company has two signatures. The relo person and an accounting manager. They are the "tenant" and under permitted tenants is the person who will be occupying the property. As someone else suggested you could do an addendum or you could make it a blanket "employee" and give the firm a form specifying the name of the next occupant and anticipated dates they will be staying. They need to sign and email the form to you for each occupancy change. --71.75.xx.xx
