Applicant had good qualification report (even though no credit) and steady employment. Said had 3 pet cats. We are willing to accept them with more money and if they provide current vet records. Doesn't have any records available. Now applicant is saying, "These cats are fixed. So you won't rent to me if I don't provide vet records / I can't move in??" I am asking in this forum if this person may have some type of case against a landlord for requiring this prior to move-in? Thank you. --71.112.xxx.xxx

No issue at all. You are requiring a record from a vet proving spay/neuter and rabies vaccine, flea prevention, plus general health check. Standard vet care for any cat or dog.

My pet owners generally just give me a copy of the vet call-back sheet. It has dates for next vaccines. If they can't provide that, I don't want them. They don't care for their animal, which means they likely won't care for my property. --131.151.xx.xx

John,I don't allow pets, but I would need records if I did,and dogs would have to be licensed with the Town also.That being said,we had three Samoyed's,Grandmother,son and Granddaughter.They were never licensed and were at the Vets about three times.the grandmother dog lived to be eighteen years.were well cared for,only the best dry dog food. In Ireland we always had two dogs,were never in a Vets office,the vet would laugh you out of the place,accuse you of wasting his time.they never got dog food,it wasn't on the market,whatever we ate,the dogs got the scraps,sometimes not much.different country,different philosophy.........charlie.....the dogs slept in the back shed...............let you know who was wandering around........................friend or foe........................ --174.199.xx.xxx

Do you have other tenants with pets? Have you required vet records from them? If you went to court could you produce those vet records? Is it in your lease?

If you've answered yes to all 4 questions then no problem. If you said no to 2-4 then it could well be a problem.

The courts will generally go along with any reasonable policy provided that is it applied uniformly to all tenants and in this instance all tenants with pets.

You should also include it on your application where you ask if they have pets followed by a clause stating all pets must be current on all vaccinations at all times and vet records are required at lease signing and annually thereafter.

If you do have tenants with pets but no written policy I recommend that you create one and send a 30 days (or 60 depending on your local laws) and make it part of your existing lease and require that they provide a copy of vet records.

The other problem is insurance. Our insurance has no breed restrictions but it does require a pet policy which we cover in a pet addendum. --71.75.xx.xx

I take dogs and I require proof of current rabies vaccination and proof of spaying (I can tell if the males are neutered just by looking)

If I took cats, I would require proof of rabies vaccination and proof of spay/ nueter. I don't want any animal breeding or unplanned litters in my rentals.

Responsible pet owners have a vet. If they got the cats from the pound, they should have a receipt that shows the cat was vaccinated and neutered when they got it.

I don't require proof of distemper type of shots. I'm less likely to get sued over a cat with distemper than I am if an unvaccinated dog bites a kid and the kids has to take the rabies series --174.216.xx.xx

I can require proof of rabies for service animals / emotional support animals, but can not require those medical animals to be spayed / nuetered.

If I had rentals in an area with fleas, I would discuss flea control with the applicant but probably not check with their vet. You don't need a vet to buy flea treatment. --174.216.xx.xx

Those of you who require proof of rabies vaccination need to know that there is an issue with vaccination every three years. It's not necessary and can kill a small dog. The amount of vaccine given is the same for a huge Great Dane or a small Chihuahua and that's where the problem is. Vets are finding out that immunity from a rabies vaccine can last seven years to lifetime so there is no need to revaccinate. You can ask your tenant to get a test called a "titer" that tells how much immunity is there. It's more expensive than just getting the shot in the short run but in the long run can cause kidney disease, skin cancers, liver problems and brain problems and deadly immune mediated hemolytic anemia. So if a tenant is afraid to get the dog a shot, suggest a titer. There is a Dr. John Robb who is promoting changes to the rabies vaccine laws. His website is SavethePets and he is being sued by a number of dog food companies since he tells people also what is wrong with dog food. He is trying to change the laws so we don't keep killing small dogs by giving the same amount of vaccine as a large dog.

When I do a home visit I like to meet their pet(s). If I smell cat or dog urine or encounter an agressive animal it's an automatic no go. If I find out the dog isn't that sweet little blah blah blah dog but a different dog definitely no because if they lie about the breed it's probably the tip of the iceberg. --71.213.xx.xxx
