Today I have a childish 25 year old tenant arguing with me that he didn't smoke pot and there was no pot smell in the hallway immediately outside of his apt in a multifamily building. I challenged him to allow me to enter, he kept quiet.

Couple years ago, we had a couple whose apt had pungent dead fish smell.. During routine visit, I didn't find any food items or anything "fishy", but smells. I know, I know, In home visit prior to move-in would have revealed that.

My question is, has anyone successfully evicted anyone who smoked in the apartment? Let's say, you can smell it, be it cigarettes or weed or whatever they smoke, but you have no physical evidence. Can't take a picture of the smell.

In cases like this, month-to-month lease is so much easier to get rid of those uncooperative/undesirable ones.. --72.209.xx.xx

Use the wipe test and prepare refinishing estimates, no juice of any kind faucet water from the kitchen - get a few towels damp and one room at a time go find the residue, bring some ziploc sandwich bags and a freezer bag for the bunch of samples. --76.188.xxx.xx

Police here are not concerned about weed either. Did an eviction one day that the house REEKED of weed. Eventually, the cops had to be called because the tenant was wanting to fight. I told the cops if they go inside, they would have a drug charge. They flat out told me they weren't interested. Too much paperwork and it wouldn't stick, so they didn't do anything for that anymore.

So, it goes back to what the lease says and how far you are willing to go with it. --98.175.xxx.xxx

This is one of those things I let slide and don't really care much. People are going to smoke and if I enforced smoking cigs or weed I wouldn't have many tenants left. Out here in Kentucky the amount of people that smoke pot is incredible. I rather someone smoke pot over cigs anyways. Cigs stink up a place semi permanently, weed does not at all in the least bit. I would go over his place and have a man to man talk with him face to face.

I would pretty much tell him that people are going to call the police on him for smoking weed and being a dumb#ss about it. Bro smoke out the window and stop being dumb or you will get busted. A down to earth talk with a pothead usually does the trick. --173.239.xxx.x

You can't take a picture of the smell, but you can take a picture of the smoke residue on the wall. (Actually, I don't know--does pot stain walls and ceilings like nicotine does?) If necessary, bill for cleaning and repainting, and then evict for nonpayment. --204.210.xxx.xxx
