Here's a question for the math brains and landlord relations bureau:

Tenant is leaving February 18th. She asked if I would prorate her rent of 18 days based on a 365-day year average, instead of the 28 days in the month of February which would cost her $200 more than an average for the year or a 31 day month. She has been a decent tenant.

What is your inclination?

I had a similar case at the end of last year with a tenant giving 60 days notice as required by law in Ontario. They gave notice November 1 and moved out November 19. I had them pay rent right the way through until December 31st (I held their last month's rent deposit). They were moving out in the dead of winter and leaving me with a vacant unit at Christmas, the worst possible time for leasing. Pro rating makes no sense in these circumstances. I would not agree to it and I do not recommend it. --76.67.xxx.xxx

We are having a family math discussion on this one and would like a little clarification. Is the tenant saying that they would be paying $200 more for 18 days in February or are they saying that the daily rate (monthly rate times 12 divided by 365) days is $200 different for a 28 day month than a 31 day month? The answer determines what monthly rate we use in our calculations. Thanks. --75.136.xxx.xxx

If the tenant rents by the month, they owe you for the month. Of course, they can keep the keys for the month as well and hold up your getting in to do work. If you agree to prorate for whatever reason works for you (get then out sooner, get the keys, do the work and get it rented next month) then pro rate based on the higher amount that you get.
