One of the tenants that want to move in is older man with dementia that has problem walking and been taken care of by his niece and nephew moving in together. Is there a medical waiver I could use to prevent a law suit from falling etc. There are stairs on the 2nd and 3-rd floor --73.194.xx.xxx |

You might consider that the niece and nephew will not be moving in to help him but are just dumping him in your unit. Find a way to not rent to him. Take it off the market for a month or so. Tell them that something has gone wrong with the plumbing, sorry, can't fix it until spring and please look in another place. Then take the financial hit and wait a month or so to re advertise. I don't see anything good coming to you from this tenant. I do see them abandoning him. Ms. Ally has it right ....this could be a case of dumping.
The home inspection even a drive by could give you many clues as the overall situation.

It sounds like the applications haven't been run yet. So if they are all applying as a group and there is something shady like drugs involved, at least one will likely fail the background check and you can legally deny the group. --72.188.xxx.xx |

Have all complete the application, run the credit, if the credit checks out. Do a visit at their present location.
Unfortunately the niece and nephew are not doing him a favor at all because he will become disoriented and forget his way home. Since the niece and nephew most likely will not care for him. They should get him into an assisted living, there they will help him with meds and other productive activities.
Plus with the dementia he should not be on the 2nd or 3rd floor with steps. Due to potential fall, then fractures a hip or other bones. Of course the niece and nephew don't want him in an assisted living because they will not get his money the assisted living will take it over time.
