State Specific Question About: MARYLAND (MD)

The state eviction policy says: "Non-payment of rent. Your landlord can begin the eviction process as soon as your rent due date has passed and you have not paid the rent. The landlord does not have to give you advance notice." - does this mean that no 'Pay or Quit' notice or any advance notice is needed here, just file eviction in Dist Court after due date?? My property is in Montgomery County, MD. Please help --96.241.xx.xxx

It is always best to download, print your local and state tenant laws, place into a 3ring binder - flip over for the state laws so they do not get mixed up, understand these before opening for business - landlord 101. But the basic lease will say when rent is due, mostly on the first so the pay/quit notice goes out on the second and after that time expires then without a complete late rent payment plus billed damages if you have that you would proceed to file in housing court for eviction or whatever it is called in your area. I notice this is the 16th so you prolly asking about a rent that cycles on the 15th --76.188.xxx.xx

Well, thanks fore your reply. This was a rental with 1st of the month due, late after that. Since there's a 5days' grace period, the creep wait for that each time to pay, this time he gave me a bad check for rent on the 6th, deposited bounced, that way it sent to 12th or 13th, not he's not paying at all, I filed on the 16th at Dist. Court in Rockville. I was confused anout 'failure to pay' and 'eviction'; thanks for clearing that up. Yeah, I'm still learning... --96.241.xx.xxx

Vee and Laura: Thanks for your inputs. I have filed a 'Failure to Pay' in Dist. Court in Rockville on 16th and got a court date on 2/12. Now I know I should've filed above on the 2nd without any concern to a pay/ quit notice, so I'd have gotten a far earlier court date than above. To recap and confirm my understanding: I would've filed in court on 2nd irrespective of grace period for late payment, which is after 10th in Montgomery County, though my lease inaccurately says 'after the 5th' (which I'll be correcting at next tenant). This is 'Failure to Pay' filing. If they not pay by the time or after court hearing, you file 'eviction' in the court to get the out of the property. That's it. There's no pay/ quit at all (or should I send them anyway a pay/ quit on the 2nd with a 11th deadline, at the same time I file in the court "failure to pay' on 2nd??) --96.241.xx.xxx
