I would certainly do that. I would clean the walls with Trisodium phosphate first which is a little box of soap powder available at the hardware store. Here in NJ we have to send the bills for work done to the tenant when we keep their deposit so you might want to check your local laws and pay someone to do it so you have a bill to prove how much it cost to fix the damage. --73.33.xxx.xxx

Does your written lease state "NO SMOKING"? If not, I'm not sure you can - but you can always try.

Take many, many pictures of before (now) AND after (you clean). This will help prove damage. Also, make sure that you give back any amount left over (if any) to the tenant. You can't just "keep" the money - you have to spend it.

One of my clients has a lease that the clause states if the tenant is found to have smoked in the apartment they forfiet the entire amount of their security deposit. I don't know if it would hold up in court or not.

You will account for the money upon move out by spending it to pay the invoice from the painter and cleaners. If may actually cost more than the deposit you are holding. Know your state law on deposits return and follow that. They may owe you more money. --99.203.x.xxx

Well you must return the unit to movein ready, if that includes abating smoke leftovers using the common seal/prime/refinish then you need estimates for this - in my area we get charged 250-300 per room which adds up fast, that is 12-1400 in a place, but you must follow your local/state tenant laws on timing the accounting statement. --76.188.xxx.xx

For any funds kept you have to document the expense (or projected expense) and give an accounting.

You know if your repaint walls as normal release/re-rent requirement what's the damage? We know ceilings aren't painted all the time on re-rent but if there's nicotine damages well that's different-- to me that could be claimed. --99.103.xxx.xxx

I disclose to my applicants now that my properties are non-smoking, and if there is evidence of smoking there is a $300 per room fee to remediate. So, 2 bedroom place would be: 2 bedrooms, 1 bath, 1 living room, 1 kitchen - 5 rooms, $1500. This covers washing all walls with TSP, priming, painting, cleaning flooring, cleaning ductwork, all fixtures, all softs (curtains, replacing mini-blinds), etc. Washing residue from cabinets, appliances, fixtures, etc. Generally, must replace all light bulbs, even if not burnt out.

You can get rid of a lot of smells using an ozone generator. They come in all sizes and prices, based on the size room or house you are trying to clean. You have to run it when no one is home. Set the timer, and come back later. --96.255.xx.xx
