State Specific Question About: ARIZONA (AZ)

If a tenant buys a home while on a lease could the landlord hold the tenant to the lease if they still have two more months left on the lease? The tenants did give more than 30 day notice that they were looking to purchase a home. --97.124.xx.xx

The termination of a lease should be mutually agreed upon in writing by both parties, assuming it states that in your lease.

Maybe you can negotiate a win-win with an early termination fee.

You may want to also mention that closing don't always happen smoothly. Some can drag on depending on repairs, title work, loan, etc. It may turn out that they may be glad to have the extra months. --108.69.xxx.xxx

If you don't hold people to what they sign for-- not only get out of business-- get out of LL'ing ASAP. You will be a door mate.

If you're not intending to abide by the contract why have one? How would it be if 2 months before your lease ended YOU called the tenant and informed them they have to leave-- 2 months early - OH I'M SURE THEY WOULDN'T HAVE A PROBLEM WITH THAT?

Yes you the tenant signed the lease. What terms did you agree to? Buying or giving heads up doesn't apply unless there is a clause in the lease about that. Read your lease. Where i live yes Tenant would be responsible and a judge would award me everything due... Just do the right thing and the right thing will happen . --66.87.xx.xxx

Most of us here have what's called an "ETF" (early termination fee) that is equal to 6 week to 2 months of rent. You can present them with this option as your "standard policy." Your renter may or may not agree to pay that, but then they owe rent until you find someone on their behalf to take over.

The trick is are they collectible. Even if you sue them and win a judgment and attach it to their house, it doesn't get paid until they sell, which could be anywhere between now and when they die in 50 years. Do they have good credit and would they care if you reported the judgment to credit bureaus? Can you find out who their potential lender is and inform them of this pending notice not to pay you?

Giving notice that a person "intends to purchase a home" is nothing. There is only one notice you as a land lord care about, and it is a notice that they are moving out. People "intend" a lot of things. Until they give proper notice AND the lease expires or they buy you out...they owe the rent. --173.19.xx.xxx
