This will be found in your local and state tenant laws, what does your housing court use to verify proof of service? Here in my area the court has reduced the delay time by using fedex photo delivery, when tenants do not sign for the court paperwork they look at the yellow paper from USPS and see the sender and just stall - starting to get backed into a corner they just freeze, and so does the court case. If you are part of a local landlord group there is likely someone there with recent experience who could answer this for you. Printing out your state and local tenant laws is the first step in opening for business, in court the manager/owners are always held to the highest standards, place these into a 3ring binder and flip over for the state rules so there is no mixups, and of course read enough to understand them. --76.188.xxx.xx

What do you need the 10 day notice for?

If it's for non-payment of rent, your lease should include a provision to waive the notice requirement (as permissible in PA). This allows you to file immediately. --73.236.xxx.xxx

In NC we can waive the notice if it is included in our lease. Check your state and local laws.

Okay, let's say I send out my "5 Day Notice to Cure Violation or Move" for a tenant parking a second car on the property of an apartment house. The first thing my tenant is going to do is call me and ask:

a) Who's complaining

b) the tenant will complain other are doing the same thing why am I only sending them a letter.

I will then send a follow up letter outlining our conversation and a email/text message. I then have 3 forms of proof.

My tenant will respond to my letter or text, giving me now 4 forms of proof they were put on notice.... --47.156.xx.xx

To answer the question - sending the letter is enough. The magistrate will ask if proper notice was given and you say yes, they never ask for proof of delivery.

As others have noted for future put it in your lease with a place for them to initial that they waive the Notice to Quit. --72.95.xxx.xx

Posting it in a prominent location on the rental (ie: front door) also works and allows you to take a photo of the posting.

My lease gives them 5 days to correct payment but no days if it is a violation of the rules......now I typically get a hold the tenants before hand so that they can bail themselves out of trouble.

State law says 10 day notice unless the lease agrees upon a different time line. --24.101.xxx.xxx
