State Specific Question About: FLORIDA (FL)

What do your leases say about guests--elderly parents for example. I'm worried one of my tenants is going to move in her parents in exchange for babysitting.

What can I add about guests to the lease to prevent this from happening in the future?

Here's what my lease says:

"Tenant shall not allow any adults not listed on the lease to stay at the Premises in a manner that a reasonable person would consider the adult to be an occupant and not a guest. If Landlord suspects an adult might be an unauthorized Tenant or occupant of Premises, evidence satisfactory to Landlord (such as lease copy, mortgage statements, paid utility bills, canceled checks for rent or mortgage payments) must be provided that shows the adult in question has his or her own permanent residence, regularly lives at own residence, and that his or her residence is not be Landlord’s Premises. Failure to supply proof to the Landlord’s satisfaction shall result in commencement of eviction proceedings for all Tenants. Tenant shall give written notice to Landlord before any occupant who is allowed by law (such as a biological or adopted child) to live with Tenant begins residing at Premises, even if occupant is staying only for a short-term or temporary time period." --129.176.xxx.xx

My lease allows for guests and prohibits other occupants not named on the lease. How to prove someone is occupying the apartment is tough for a LL. I like Jody's clause requiring tenant to prove someone is not occupying the apartment and will add that to my lease. My clause:

Lessee shall not assign, rent, nor sublet the leased apartment or any part thereof without the prior written approval of Lessor. No additional individuals will be allowed to occupy the leased apartment without the written consent of Lessor. Rent may be increased, during the term of this lease, due to additional occupants. Occupancy by guests (limited to four at time) staying over fourteen (14) consecutive days, or more than fourteen (14) days in a calendar year will be in violation of this provision. The Lessee is liable for all breaches of this lease and City, County, and State codes, laws, etc. caused by Lessee and Lessee’s occupants or guests. Lessor may bar individuals from the building and/or Lessee’s premises. All guests and invitees of Lessee shall observe all rules and regulations of the building. If guests violate these provisions, they may be barred and/or arrested for criminal trespass. Violation of this is grounds for termination of Lessor’s tenancy. Increased water costs occurring during the time of guests being present shall be covered by the Lessee. In the event any other people occupy and live in this rental, in any capacity, without Lessor's written consent, it will constitute a breach of this lease and the rent will immediately increase an additional $200.00 per new person (i.e. not noted on this lease) per month and the Lessor at her sole option may terminate this lease. --216.99.xxx.x

3. GUESTS/OCCUPANTS: The residence will be used only for housing persons listed on the Rental Agreement. Additional Tenants must be approved in writing by the Owner/Agent and are subject to full screening procedures. Persons other than those specifically listed on the Rental Agreement shall be strictly prohibited from staying in the rental unit for more than four (4) consecutive days, seven (7) days in any one (1) month period, or a total of twenty (20) days in any twelve-month period. For purposes of this section, “staying in the rental unit” means presence on the premises for a substantial amount of time, whether during the day or overnight, and shall include, but not be limited to, long-term or regular house guests, live-in baby-sitters, visiting relatives, etc. Tenants shall notify the Landlord in writing at the earlier of: any time the Tenant expects any guest to be staying in excess of the time limits contained in this paragraph; or when such person in fact stays in excess of such time limits. Subsidized Tenants shall be required to submit a report to the Landlord identifying any persons not identified on the rental agreement and staying in the rental unit for more than four (4) consecutive days, seven (7) days in any one (1) month period, or a total of twenty (20) days in any twelve month period and shall state whether such person is contributing to the income of the Tenant and to what extent. --24.21.xx.xx

OCCUPANTS. Only the designated TENANT (S) and the following persons shall occupy the premises:

Anyone who is not named in this paragraph, or who does not sign this lease, may not reside on the premises. Anyone not listed above must not stay on the premises without the LANDLORD’S prior written consent for more than 10 consecutive days or more than twice that many days in any one month. All persons who wish to reside on the premises must be named in this paragraph, be submitted to our screening and application process and, if over age 18, sign this lease.

If any adults occupy the premises other than those listed herein, the LANDLORD shall have the option of pursuing any remedies allowed by law, including terminating the lease, or increasing the rent in the amount of $100.00 per additional adult.

The provisions of this paragraph do not apply to the TENANT’S minor children except that the total number of persons occupying the premises shall not exceed two per bedroom. (Sec. 441.060, R.S. Mo.) Upon request by the Landlord, the Tenant shall provide satisfactory proof of his familial relationship to other occupants of the premises or the name and address of any person visiting or temporarily residing on the premises.

The Landlord is not obliged to allow any other person access to the premises without the tenant’s written instructions.
