At someone that has an FED for any lease violations outside of non-payment of rent?

A post on facebook got me thinking last night.... so the tenant (Not one of mine) pays her rent all the time before it is due. Never a bounced check or non-payment.

She had a maintenance call and the contractor found that her house was a mess. Like a crazy mess. So the Landlord told her that she had to get it cleaned up or she would file for an eviction.

The tenant said it would not effect her in the future as it was not for non-payment.

But anytime I am on Iowa Courts online - and there is an FED, it is just an FED. They don't list that it was for not keeping the property up or what the deal is, so I have always assumed they were for non-payment.

If someone told you they had an FED - due to something different than non-payment, would you look at them differently? Or is an FED an FED and a automatic denial?

I do not know what a FED is or how it appears on iowa court

Here in MI, LL first sends a PAY OR QUIT notice for non-payment. After seven days, LL can fine in court. If for something different than non-payment, then a NOTICE TO TERMINATE. After 30 days, LL can file in court.

So here in MI, they have 30 days to cure a lease violation other than non-payment of rent. If LL still files eviction in court, thats pretty bad and automatic denial --50.4.xxx.x

I'm assuming that with everything going on with now, that if you are evicting them for say a dirty house, then it would still be an FED. I wonder if the courts will now start putting more nots that can be seen online.

FED is forcible entry and detainer.

I would not rent to them because either way they had to be evicted.

Some LL's are probably evicting for other things because they can not evict for non payment in some cases due to the moratoriums.

I have 3 main criteria for a tenant and I spell them out on my fingers to each prospective resident:

#1) Pay your rent. (Pay your rent. Pay your rent.) We don't work with anyone on that. If you can't pay your rent borrow it from your relatives, I'm not your mom.

#2) No drama in the driveway. No cops unless they are your friends.

#3) Take care of the place. Keep it clean, report maintenance issues promptly. Don't be your own handyman - let US take care of our properties.

That takes into account all the main reasons I would want to evict. --50.82.xxx.xxx

I don't rent to people who have evictions for any reason. I would almost look at the eviction for something other than non-payment as being even more disqualifying than non-payment. It likely has to be really bad or you have to be an overall low quality tenant to get evicted for something other than non-payment. --70.178.x.xx

I don't think I would rent to them either, but trying to look at all sides of this as we have someone that is making application - after they were given the applications and my disclosure attached.

Living in a small town, gives me some advantage... so I looked her up on Iowa Courts Online. Ummm HARD PASS! Next.

But she insists that she is applying and will qualify. So I am going to let her and she is going to get the denial email. --98.22.x.x

I do rent to people with an eviction on there record, but only if there is a zero balance on what is currently owed and the eviction was about cash.

If someone fell on hard times but made it up, that shows to me that they are trainable.

If they blew off the balance owed, I figure they think I have a tattoo that says next victim. --24.101.xxx.xx
