I have an older lady interested In renting my condo who is on Section 8. Her son lives in the same complex so it is nice for them so that he can help her as she ages. However section 8 is taking so long that her notice to vacate her current unit is almost over and she doesn’t even have a signed lease with me. No one has contacted me for an inspection and I have no idea what they will determine is the market value for my unit. I really want to end it. Is it too late now? At what point am I locked in?

Also I made a mistake by not putting an end date on her holding deposit. I just stated that if section 8 didn’t get approved the deal was off. So technically it hasn’t yet been approved that I know of. --73.93.xxx.xx

When I have to "wait" for an outside approval for an applicant, and it's going to take longer than 1 week, I put the "cost" of my lost rent onto the applicant. Meaning if the rent is $1295 a month, divided by 30, equals $43.17 in lost rent per day. If the applicant doesn't agree and pay me money for lost rent beyond the 1 week period, they loose any guaranty of my holding the rental and I'll market to to others. Besides in California, I will never ever take another section 8 tenant, due to their lies and deception. --47.155.xx.xxx

Send her deposit back and rent the unit to someone at market rate. Section 8 has given you a taste of what you will endure if you continue this deal.

As you said, there is no signed contract with anyone and there is not date for the end of the hold period. The deposit can be returned at any time. Do it!

Next time, have a signed Holding Fee Agreement that gives them 2 weeks to pay all move in funds and switch utilities into their name (if applicable). If they cancel for any reason or fail to complete the process on time, the fee is retained as liquid damages for the time you held the unit open for the applicant. Btw, call it a FEE not a deposit. Deposits are refundable by definition. FEES by definition are not refundable. --107.216.xxx.xxx

Keep her on the back burner, but also keep advertising for other tenants. If someone else signs the lease before S8 gets back to you, return her money. No need to get rid of her until you have a guaranteed tenant ready to sign. --71.233.xxx.xx

I always see these crazy stories with Section 8 and all the "drama" that goes along with it and I am honestly shocked. We have one apartment complex that is Senior/Disability and it is the only complex that we accept the Housing Voucher at. So I can limit who goes into it. All of my units are the same so I know the drill and have everything done on them so that I don't have to wait for the housing department.

My contacts there are a-m-a-z-i-n-g honestly. Last friday we did a virtual walk thru a unit and I just did a facetime call with the one lady and everything was done.

So thankful I don't have to deal with the BS that you guys do.... but then again, my tenants there are Seniors or have a Disability.

Fyi. When i accept an application the tenant gives me their packet. I fill it out and turn it in. If that hasn't happened then try and find out what is next, your state may have a different process than mine. --172.56.xx.xxx

Thank you all for your input. I really appreciate that you took your time to help me.

I have been super distracted by my day job and realized that they never sent me proof of income. So recently I asked for it again and her son sent me a falsified bank statement yesterday confirmed by two bankers today.

This made it very easy for me to cancel the holding deposit on the terms that S8 was taking too long and that they provided false proof of income. BTW today is exactly two months.

Contact the Housing Office. let them know what is going on and then contact the potential renter. Tell her that the people at Housing are not moving on this and that you will be showing the house to others who may want to rent it. That is if you want her. Otherwise contact her and say that you are not willing to wait any longer and that she is out of luck. --24.233.xxx.xx
