State Specific Question About: VIRGINIA (VA)

What is the legally late fee I can charge in VA for my rental property? Is $25/day legal? --158.72.188.48

It is legal but most judges won't allow it. You are better to have a flat fee and knowledge of how to file an eviction. If you pile on $25 a day and then do nothing to remove the tenant - just pile up daily late fees - judges probably won't like that.

Have grace period and then serve/mail 5-day pay or quit after that and then UD on the 11th or 12th. --205.188.116.5

I charge a flat $50 on the first late day and then do what Wallace advised. In my county I can have them out before the end of the month. --134.126.15.41

in fairfax, we're charging 59 after 5 day's grace period, not paid by 10th - then increasing @ 15 per day in addition. will find out what's legal soon.

I go for the flat fee strategy. However, the late fee is due on payments received after the 1st. And this has stood up in court many times. No check received on the 1st? I send a late notice on the 2nd mentioning that the rent is overdue and the late fee is expected to be paid. Hey, a landlord club sounds good, by the way. Unfortunately Virginia is a large state and some people who have responded live several hours from me. I'm in Northern Va. --66.44.102.211

Hey, another Nova person! That's great! I have properties in PW and Fairfax ctys. How about you? I know of real estate investment clubs but not a landlord specific one in this area. The REIC is great but geared more towards acquiring rather than maintaining. --66.44.109.127

Icharged 25.00 late fee after the 5th of the month. Five dollars a day untill the rent was paid in full. Judge said it was shameful and only gave me the 25.00 --68.20.140.8
