Tenant's money order has not been received yet. I filed a complaint for failure to pay rent on Monday and the trial is set for next Tuesday.

He called me when he received the nonpayment notice and verified to my satisfaction that he had purchased and mailed the money order.

What do I do now? Do I still go to court? What arrangements should I make for him to pay the rent? Thank you. --12.77.55.40

You absolutely go to court. The lost money order is NOT your problem, it is his.. If he can't produce the full rent by the court date, he gets to move.

I bet it takes a while to get a lost money order replaced. Ask him for this month's rent in cash or I'd go to court next week. Get your money's worth~so you don't have to start all over if the tenant can't come up with the money. --172.202.158.148

This is what they do. they buy the money order. Fill it all out. Make a copy of it or keep the carbon. Then return to the place they bought it and say they filled it out wrong and want there money back. Then they show you a receipt and you believe them. What is happening is that they most likely are renting another place and are using your real rent money as payment on the other place!!!!!! --205.188.209.13

Many of us have heard made-up stories about money orders. However, I also have had two completely honest ones. Because I had never known the tenants to lie, I accepted their stories and waited until things got straightened out. Each was a lower income tenant who would have had an extremely difficult time making an additional rent payment.

In one case, a letter was stolen (unfortunately, probably by a post office employee). The money order was cashed with a forged signature at one of the sleazy check cashing places that doesn't ask for ID. In the other, the letter got chewed up by post office equipment. It took a couple of months for things to be straightened out.

My first choice would be to ask the tenant to make good on the rent and then drop the court case if he does. If he clearly can't do that, but I believed him, if it were my court system I probably would ask for a continuance to give the tenant an opportunity to get it straightened out before having a judgment against him. Or, I would get the judgment but not take further action for eviction or garnishment until the tenant had a chance to straighten it out. --205.188.209.13

As Carolyn mentions, you can indeed get an honest lost in mail. Rare, but it does happen.

You might be able to develop some quick intel by calling the 800 number shown on the M.O. A synthetic voice will ask for the serial number of the document, followed by the Yes/No as to whether it has been cashed and that date.

If the cashed date is recent, suggest smell a rat. Let's recap here: money order bought, filled out to Detra Enterprises. It's stolen from the mails and the evil-doer is able to suddenly arrive somewhere with credentials for Detra Enterprises to cash the money order. Naa, ain't hapnin'. In such a case, I'd press on with the court date.

If they truely got a money order for the rent, then they have the money order receipt. The receipt will have the purchase date and time. If they can provide that, then MAYBE let them have a few days to get the money order stopped and reissued. If you want to wait. Otherwise, payment is due on the first as stipulated in the lease. It is their responsibility to get the money to you in a usable form, not your responsibility to pull it out of them. --24.9.240.44

Along the lines of the last few posts, if you are 100% satisfied that the MO is legit and the tenant is generally reliable, you might want to give them the benefit of the doubt. I'd add two things. 1) It's easy to write the original money order to a friend and write anything they want on carbon paper over the copy. 2) Locally it takes about 6 weeks to get a replacement for a lost/stolen money order. --24.94.240.244

I once tried to trace a money order, I was told it could take up to 3 months. That was about 10 years ago things may be faster now. I am not very trusting so I would make him pay up-front. --208.157.231.117

I've heard the one about a lost money order more than a few times in 8 years.

I've even had tenants swear on a stack of bibles that they mailed it out several days ago.BUT, when I receive it in the mail,the printed date on the money order/cashier's check is only a day or two ago.

What are these yokels thinking?

Now ,there was 1 month in which 2 different tenants swore that they mailed out the payment on a certain date to my P.O. box.They both showed me their receipts to prove it. They were right.

Although we're just across town,in the same city,their rents were finally put into my box TEN DAYS after the postmarked date on the envelope.

In my opinion, the whole money order story is irrelevant. The rent hasn't been paid. If they truly mailed a money order then that is great news for the tenant because it will either show up or they will get it refunded to them in about 4 to 6 weeks. In the mean time, they need to borrow the rent from a friend or relative and pay you. If that can't do that to avoid an eviction then they are living so close to the edge that you are probably better off getting rid of them anyway. --24.128.227.165

Go to court and get the eviction order. Then if you want you can give the tenant more time. IF it comes up in court i tell the judge, 'mrs jones and I have agreed on a payment plan for the back rent, but I want a eviction ruling today incase things don't work out.' --68.226.186.203
