Does anyone have anything in their contracts that states that if it is the result of the tenant that mice,rodents,etc.....come into the house as a result of tenat negligence to properly put food away that theu are responsible for the full amount that the pest control people will charge? And if so how much is the amount stated and how is it worded? This is a new issue for me. It use to be that the board of health would let you set traps now they require that you pay to have a company come out and recieve a certificate that they have been exterminated. | I wish. I had one tenant, the biggest slobs I have ever seen in my life call me about mice. I gave him some traps. He said he thinks contsruction two blocks away was bringing up mice. I said maybe you should clean up the kitchen? He looked at me funny, and i gave up. --199.50.29.40 |
| Evidently, your tenant turned you in to the BOH, and got them involved. I had a tenant that refused to let me take care of roaches, but they called the BOH and they insisted that I hire the work done and prove it. If you've got mice I'd make sure to have in your agreement that YOU are not responsible for their stuff and that you are NOT responsible for insuring anything except the house. Mice can do a world of damage to furniture. I'd be careful with this one because it could go either way if you had an idiot judge. There may be some small hole under a cabinet or a gap next to a drain pipe that they could take a picture of and say your house won't keep them out and they've ask you time and time again to seal the place up. I'd try to solve the problem and get rid of the pest. If they're the cause I'd get rid of them too but I wouldn't go after them for it. I'd let any mice damage go. That's also what inspections are suppose to prevent. I've made an inspection and mice poop was all over the floor and they were just sitting there blaming it on me. | It sounds like the tenant's are setting up the free rent trick if code enforcement is involved. Be very careful here. The state sanitation code requires you to keep the unit free of rodents and roaches, but it requires the tenants to keep the unit in a sanitary condition. The custom is that the LL is responsible unless the tenant admits they caused the problem. Your best option is to get the unit declared rodent/pest free and get a re-inspection asap.
