Hi, I had a contractor who did more than $600 worth of job for me on my rental. I wrote checks payable to his name. He told me he doesn't have a company and I don't have a company either. My rental is under our names. My question is: If I don't have a company , do I still have to give him 1099 form ? thank you so much for all the info. --66.136.23.7 |

there is no Staples store in Houston. I just checked irsdotgov, and there are a 2003 1099H, 2004 1099G, 2004 1099Q, 2004 1099PATR .. etc. which one should I get ? Yes Radar, my contrator told me he doesn't have to report the income I gave him b/c it's less than $3000. In the future, get the social security number at the beginning. I have a blank for it on the independent contractor agreement that I use. And yes, you should file a 1099, and he is required to report the income on his tax return. | Yes you have to file the 1099 or you might get in trouble yourself. If you don't have the SSN & they refuse to provide it then you still issue the 1099 and you provide the IRS with as much information as you know (ie: name & address & amount paid) - under SSN I would write "Refused to provide to me". Although I think if you tell the contractor your plan he'd be smarter to give you the SSN as a 1099 with "Refused to provide to me" written on it sounds like an audit waiting to happen for the contractor. --24.128.227.165 |

I just called him he said he 'DOES NOT HAVE A SOCIAL SECURITY NUMBER'. what am I dealing with here ? I don't know much about his background. | Does he have a contractors license number? If so use that. He probably has a SS# and just is refusing to give it to you. You are legally required to see the SS# of anyone you hire as an employee, but he was not your employee, he is an independant contractor. --216.228.163.40 |

If he refuses to give me his info just because he doesn't want to report his income, that's his problem. | He is lying and just trying to avoid the taxes. As long as you send in the 1099 (even without the SSN) you should be fine. As far as the contractor, once he realizes he has to pay taxes on the money or he gets audited due to this, he probably won't be working for you any longer (at least not at the current rates he was charging you). --24.128.227.165 |
