Liability (by Mary Sue [MI])

I have a landlord policy and an umbrella policy that is supposed to cover me for liability and legal defense. I have a former tenant suing me for fraudulant acts they committed or falsely claimed carbon monoxide and insect infestation which they say caused them thousands of dollars in temporary housing and moving expesnes. Both the insurance company and I agree that have great evidence against them. However, since there are no claims of property damages or bodily injurires my insurance policy may not pay for my defense or liability.

Where can we landlord get good full liabiity insurance. Shouldn't they cover me for defense for fraud? Please advise. 66.73.12.71

I would think that they should cover defense costs. You need to be a squeaky wheel on this one. Don't just lie down if your adjuster says it isn't covered...get his manager involved and be a pain in the rear. often the squeaky wheel gets the grease.

good luck. 67.25.228.71

We will all hope for your sake that it is a nuisance suit and your ex-tenant will go away when you don't agree to settle out of court. Many suits are filed for no other reason that insurance compnaies will pay rather than to fight.

Good luck. We are all here on your side. 216.176.9.58
